5. MATTERS CONTINUED FOR DECISION <br />a. PAP-55, Appeal of Case PDR-329 (WalMart Stores) <br />Continuation of the public hearing on the appeal of the Zoning Administrator's approval <br />of an application for design review approval to install a new condensing unit with <br />masonry screen wall at the rear of the existing WalMart store located at 4501 Rosewood <br />Drive. Zoning for the property is PUD-I/C-O (Planned Unit Development - <br />Industrial/Commercial-Office) District. <br />The application was withdrawn by the applicant. <br />PUBLIC HEARINGS AND OTHER MATTERS <br />a. PCUP-102, David Moeller <br />Application for conditional use permit approval to operate a self defense facility within <br />an existing building located at 5724 West Las Positas Boulevard. Zoning for the property <br />is PUD-I/C-O (Planned Unit Development -Industrial/Commercial-Office) District. <br />Mr. Iserson presented the staff report, and described the proposed project. The location of the <br />Parkside neighborhood on the other side of Tassajara Creek led staff to work with the applicant <br />and add a condition of approval that his customers must park on the other side of the parking lot <br />_ to reduce noise during early morning uses (7:00 a.m. - 8:00 a.m. on weekdays, and 7:00 a.m. - <br />9:00 a.m. on weekends). Staff noted that there was sufficient parking on the site. Staff <br />recommended approval of this item. <br />THE PUBLIC HEARING WAS OPENED. <br />In response to an inquiry by Commissioner Fox, David Moeller, the applicant, confirmed that the <br />Pleasanton location would not offer cardio-kickboxing classes and that the music would remain <br />at a low volume. He added that self-defense would be the focus at the proposed location. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Arkin moved to approve PCUP-102 as conditioned in the staff report and <br />subject to the conditions listed in Exhibit B. <br />Commissioner Kameny seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Kameny, Maas, Roberts, and Sullivan <br />NOES: None. <br />ABSTAIN: None. <br />ABSENT: None. <br />_ Resolution No. PC-2004-01 was entered and adopted as motioned. <br />PLANNING COMMISSION MINUTES January 14, 2004 Page 5 of 22 <br />
