Section 7.0~: Large accumulations of refuse shall be collected and removed for a special service charge at the rate of $6.00 per l~.our for the services of two (2) men and a truck. The mini,~um special service shall be considered fifteen minutes requiring a charge of Section 8.00. REFUSE. COLLECTION CONTRACT. Section 8.01: For the exclusive privilege of c01tectin~ removin~ and disposing of all refuse in and from the Town of Ple~Santon, and the collection of tile rates therefore as herein [~rescribed, a contract shall be entered into by the Town of Pleasanton in accordance with and subject to the terms and cor~ditions of this ordinance, The City Council by resolution shall have the power to provide for the inclusion in such contract of such terms as it may deem necessary to protect the best interests of the Town of Pleas~nton. Section ~.02: In awardin~ a contract under this ordinance, the City Council shall consider the type of equi[~ment to be used, the amount of money offered. the responsibility of the bidder and the ~ast experience of the bidder. Section 8.03: An award of such contract shall confer upon the person to whom the contract iS awarded, the exclusive right. durin~ the term of the contract, to collect. transport and dispose of refuse produced or accumulated within the corporate limits of the Town of Pleasanton, subject only to such exceptions as are specifically set forth in this ordinance; and all i~rovisions of this ordinance applicable to the contractor shall constitute and be a part of any coratract awarded hereunder. It shall be unlawful for any person, other than the person to whom such contract shall be aw~.rded, or to whom such contract may be assigned vith the consent of the City Council of the Town of Pleasanton to collect or re~!.ove refuse in ~u]d from the Town of Pleasanton exceiDt as herein provided, Section 8.0~t: The person to whom such contract shall be awarded shall file with the City Clerk of the Town of Pleasanton a bond for the faithf u! performance of the contract in tile ~um of Five thc, usand dollars ($5,000.00). Section 8.05: The term of such contract shall be for no~ more than five (5) years from the da~e of <;ontract, provided that contract may provide for an option to extend said. contract for an additional five (5) years. The City Council shall ~ive the contractor ninety (90) days notice in ~'ritin~' before termination of the contracts Section ~].06: Such contract shall also require~ that said contractor [~rocure for the period covered by the ?ro~osed contract, full compensation insurance with an insurance carrier as defined by and in accordance with the ]~rovisions of an Act of the Legislature of the State of Ce,.lifornia, known ~uld com~nonly' called e~l~'ork~nen~s Co~n,~ensation Act, ~ ap~roved ~iay 1913, z~nd as subsequently 8i;,-ended. Such contract shall also require that said contractor carry ~ublic Liability Insurance to the amount of One Hundred Thousand Dollars ($100,000,00) for -5-
