Commissioner Roberts reconYened the meeting at 10:32 p.m. <br /> <br />THE PUBLIC HEARING WAS RE-OPENED. <br /> <br />Hoss Bozorgzad clarified the placement of the pathway in relation to his house as <br />discussed by the Commission and identified the public trail easement. He reiterated his <br />concern over the patrolability of the trail. <br /> <br />Ms. Nerland noted that the City had a recorded agreement between the Bozorgzads and <br />the Bachs, drafted by Mr. McDonald, dealing with the roadway and easement issues, and <br />the resulting payments. <br /> <br />Mr. Bozorgzad recalled the history of the design of the pedestrian pathway and his work <br />with his engineers and the City planners. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />The Commission examined the site map and engaged in further discussion on the details <br />of the site. <br /> <br />Commissioner Fox moved to recommend approval of Case PSP-08 to delete the <br />pedestrian sidewalk from the PUD development plan. <br />Commissioner Roberts seconded the motion. <br /> <br />Commissioner Roberts did not believe this pathway was meant to be a trail and that it <br />was more appropriate to serve as a cut-through.
