He was also concerned about the liability of a public path as well as the safety of children <br />bicycling on the steep path. He was concerned about the visibility and patrolability of the <br />path, especially since the path is so steep. <br /> <br />Jill Guasco Swain, 4755 McHenry Gate Way, spoke on behalf of her neighbors, Matt and <br />Summer Bocker, who were out of the country and submitted a written statement. She <br />was also very concerned about the safety of children using the path. Her neighbors live <br />at the bottom of Sycamore Terrace and they opposed a pedestrian path that would adjoin <br />San Carlos Way and Sycamore Terrace because they believe it was poorly planned and <br />did not serve a needed purpose. They believed the 30 steps would rule out its use as a <br />bike path and added that it was not ADA-compliant. The path would increase traffic <br />because Sycamore Road had no sidewalks or bike lanes to accommodate the additional <br />use. They expressed concem about passersby attempting to pet or feed their farm <br />animals. The potential for accidents would increase when the golf course opened. <br /> <br />Jack Keane, 417 Sycamore Road, noted that he lived directly across the street from the <br />proposed development and expressed concern about the proposed path in terms of police <br />patrolability. He noted that two access paths served the North Sycamore area and added <br />that this path will not be ADA-compliant or bike-friendly. He urged the Commission to <br />delete the pathway from the North Sycamore Specific Plan. <br /> <br />Kevin Close, 871 Sycamore Road, believed the path should remain as is and added that it <br />was a difficult place for children to travel to school. He believed there should be a <br />three-way stop sign at Sycamore Road and Sycamore Creek Road. <br /> <br />Mojgan Bozorgzad, 6056 Sycamore Terrace, agreed with her husband's statements <br />regarding safety issues, noise, and liability. She noted that the police would not be able <br />to see the path from the road. <br /> <br />Ed Lamb, Jr., noted that he concurred with staff's finding regarding the privacy for the <br />Bozorgzad home. He would like the opportunity to present the history of the Bachs' side <br />of the project administratively if needed regarding the water line and the wall because of <br />the cost implications of those projects. He noted that with respect to the Greenes' <br />concerns, he would alter the current plan if feasible and if it would improve the drainage. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />In response to an inquiry by Commissioner Blank whether it would be possible for <br />someone do travel San Carlos Way to Sycamore' Creek Way and to remain on public <br />property at all times, Ms. Nerland replied that the easements dedicated in 2000 were <br />drafted to provide that ability. <br /> <br />A discussion of the placement of the pathway with respect to the parcel map ensued. <br /> <br />The Planning Commission recessed for a break at 10:26 p.m. <br /> <br />PLANNING COMMISSION MINUTES February 9, 2005 Page 17 of 22 <br /> <br /> <br />
