The <br />Commission also feels the school boundaries are not a major issue since boundaries between schools <br />change over time. <br /> <br />d. Tract 6502. Uta] Prooerties/Suncrest Townhomes <br />Application to subdivide an approximately 2.3-acre site into 26 townhome lots and six common <br />space parcels located at 3374 Santa Rita Road. The property is zoned PUD (Planned Unit <br />Development) - HDR (High Density Residential) District. <br /> <br />Mr. Plucker presented the staff report on the application for vesting tentative map approval to <br />subdivide two properties totaling 2.26 acres into 26 single-family residential lots and six common <br />lots located at 3374 Santa Rita Road. The City Council also approved this PUD development plan <br />with some modifications made to the soundwalls. <br /> <br />This vesting tentative map is nearly identical to the fIrst version. Changes have been made to the <br />soundwall by replacing the wrought iron portions with solid soundwall and installing a wrought iron <br />fence between the tot lot and the private street. With these two changes, staff recommends the <br />Commission approve the vesting tentative map. <br /> <br />Chair Barker inquired if the change in the tot lot reduced the parking. Staff advised only one space <br />was eliminated. <br /> <br />. Commissioner Wright inquired of staff about Condition 3 and the maintenance of the traffic signal. <br />Mr. Higdon advised this condition exists because the signal light only serves this private <br />development. Commissioner Wright is hesitant to require the Homeowners Association to assume <br />this maintenance fee. It was advised that the City maintains the signal with the on-going maintenance <br />fee. Mr. Beougher advised that the City has this agreement with three other developments. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Arlene Utal, 712 Bancroft Road, #1l8, Walnut Creek, stated she was asked to secure a $5,000 bond <br />on the traffic signal. She is unsure of her options regarding the Homeowners Association being able <br />to enforce the maintenance of a signal light. Mr. Beougher advised it is the policy of the City that <br />when a traffic signal only benefits one property, that property is required to maintain that leg of the <br />traffic signal. He also advised the payment would be handled similarly to a landscaping maintenance <br />fee. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />In discussion, Commissioner Wright advised that this could be handled in two ways: the developer <br />float a bond and the interest would pay for the maintenance, or the Homeowners Association assesses <br />each resident a fee for the maintenance.
