.

.

.

PUBLIC HEARING WAS RE-OPENED

Mr. Krah described their proposal for decorative paving in the project. They propose the
rectangular- shaped motor court be asphalt. The long driveways, drive approaches, and front
walks to each unit would be decorative paving. Mr. Krah did not propose that the motor court
entrance would be decorative paving. However, entering the motor court will be like entering
a driveway; motorists will know they are entering another area.

PUBLIC HEARING WAS CLOSED

Chair Barker would like to have the decorative paving across the motor court entrance and
concurs with the asphalt paving on the rest.

Commissioner Wright does not support the decorative driveway entrance. He would just like
to add a condition stipulating the use of a concrete sealer.

Discussion on Condition 15 ensued. Mr. Beougher advised there is a difference between
"enforce" and "empowered." Mr. Beougher will review the CC&Rs.

Commissioner Cooper would like to delete Condition 22 and would like to revise Condition 19.
Staff commented that this application cannot condition a third party. It is put on the developer
who then would go to Kaiser to perform the necessary stabilization work.

Commissioner Wright would like to keep Condition 22, adding that the garbage cans can be
stored either in the garage or in the side yard.

Commissioner Wright motioned, seconded by Commissioner Dove, making the PUD
findings and adopting a resolution recommending approval of Case PUD-91-11-1M to the
City Council, subject to the draft conditions of approval, with the following modifications:

Delete Condition 14.
New Condition: The concrete portions of the driveway shall be sealed and made
impervious to oil.
Condition 3C: Delete the last sentence. First sentence of next paragraph to read:
"The developer shall prepare standards for spas, swimming pools, decks,..."
Condition 22: Modified to read: "Trash and refuse cans shall be stored in the unit's
garage or side yard..."

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Cooper, Dove, lA1tz, Wright and Chair Barker
None
Commissioner McGuirk
None

Planning Commission Minutes

Page 10

November 6, 1996
