Regarding adding a store front appearance to the side of the building, the Mr. Trani intends to keep
the front of the store as the main entrance, however, he would like to keep the side elevation as
proposed so it is visible to traffic coming off the freeway.

.

Commissioner Wright inCJ.uired if the a\l\llicant would agree to the sbortened bours. Mr. Trani
disagrees with reducing the hours at this time; if it became an issue at a later date, he would agree
to reducing the hours. The security presence should mitigate any trouble, and the longer hours
should not be a concern.

Mr. Trani advised he has four other establishments located in Chino, Burbank, Fresno and Montana.

Commissioner McGuirk inquired of staff if the 10 pm closing meant that people coming in before
10 pm could stay until they are done with their laser tag games. Staff agreed, however the curfew
law was also taken into consideration by staff when they proposed the reduced hours. Mr. Beougher
advised the curfew is midnight on weekends.

PUBLIC HEARING WAS CLOSED

Commissioner Lutz feels it is reasonable to change the security to start at 3 pm on school days.

Commissioner Cooper supports staff recommendation to reduce the hours of operation, agrees the
security is not needed until 3 pm on school days, and the main entrance should be on the building's
west elevation.

.

Commissioner Wright also concurs with security starting at 3 pm on school days. He was uncertain
whether he would agree to the change in business hours; however, he does agree with Commissioner
McGuirk that customers arriving before 10 pm could stay until they are done playing laser tag.

Commissioner McGuirk noted he has been to a similar laser tag operation in Dublin and did not
notice a parking lot loitering problem. He would like the shopping center storefronts to remain as
they are (i.e., no darkened windows). He will support the application.

Chair Barker supports the application because it gives youth something to do. She does not agree
to darkening the store front windows.

Commissioner Lutz motioned, seconded by Commissioner Cooper, making the conditional use
permit findings and approving Case UP-96-46, subject to the conditions of approval listed in
Exhibit B, with the following modifications:
Modify Condition 6: Security guards will be on site during all non-school hours, to be
reviewed in six months.
Modify Condition 9: No external noise to exceed 50 DB.

ROLL CALL VOTE
AYES: Commissioners Cooper, Lutz, McGuirk, Wright and Chair Barker
NOES: None
ABSENT: None
ABSTAIN: None

.

Planning Commission Minutes

Page 4

September 25, 1996
