<br />. <br /> <br />. <br /> <br />- <br /> <br />. <br /> <br />During the week there will be five employees on site, weekends will have up to ten employees. <br />Hours of operation are proposed to be Sunday-Thursday, 10 am to 12 midnight, and Frida~-Satut(\a~ <br />from 10 am to I am. <br /> <br />Staff feels this location is appropriate for the use; staff has foun.d amusemen.t facilities bave worked <br />well in other retail centers in the City. The peak use hours would occur outside of the regular <br />business hours of the surrounding businesses, thereby mitigating parking problems. However, staff <br />feels that it is a benefit that some of the stores (Office Max and Cost Plus) will also be open during <br />some of the evening hours and should eliminate the laser tag facility being used as a "hang-out." <br /> <br />Parking is available to the rear of the facility and a breezeway has been installed for access to the <br />rear parking. Staff feels there will be adequate parking available for this type of amusement facility. <br />Bicycle racks are also available. <br /> <br />One concern of staff is that part of the laser tag arena is bordered by the existing glass storefront. <br />Staff would not like this window darkened to accommodate the laser arena. Also, the proposed <br />entrance is on the south elevation, and staff does not feellhis location should be the main entrance. <br />Staff would like to see the storefront appearance remain consistent with the rest of the center with <br />an entrance on the west building elevation. Staff is willing to work with the applicant on another <br />design for the facility. <br /> <br />A few tenant concerns were brought forward, but the tenants have stated that the applicant has been <br />able to mitigate their concerns. A resident was concerned about the sale of beer and alcohol. There <br />is a condition prohibiting the sale of beer and alcohol. Staff has conditioned the permit with the <br />requirement of a security guard. Staff also proposed to restrict the operating hours to 10 am to <br />10 pm, Sunday-Thursday and 10 am to 12 am on Friday-Saturday. The police department supports <br />this request. <br /> <br />Sound mitigation and the presence of a security guard are covered in the conditions of approval. <br />Based on their analysis, staff is able to make the conditional use permit findings and recommends <br />approval of Case UP-96-46, subject to the conditions of approval listed in Exhibit B. <br /> <br />Commissioner Wright clarified with staff that any changes made by the applicant with staff would <br />supersede the current Exhibit A. Staff agreed. <br /> <br />Commissioner Lutz spoke to Condition 9 and sound proofing. He inquired if it would be better to <br />say that the music could be no higher than what would produce a 50 DB sound level in the <br />surrounding suites. Staff agreed this suggestion could be included in Condition 9. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Nick Trani, San Ramon, President of Holoz Laser Tag, represented this application. He commented <br />that during the day while the kids are in school, they cater to a business lunch crowd. He feels that <br />having security during these hours is unnecessary and is an expense he would like to eliminate.
