Lamorinda Development and Investment <br />Application for a Planned Unit Development major modification and development plan <br />approval to allow the construction of a fast-food restaurant with a drive through, a service <br />station with a convenience store and car wash, and two future restaurant pads located at <br />5050 Hopyard Road (Hopyard Road at Gibraltar Drive). Zoning for the property is PUD <br />(Planned Unit Development) - I/C-O (Industrial/ Commercial-Office) District. <br /> <br /> <br />Application withdrawn by applicant. <br /> <br />h. RZ-96-0l. Citv of Pleasanton <br />To consider amendments to the "Definitions" and "Residential" sections of the Pleasanton <br />Municipal Code to add "Secondary Units" as conditionally permitted uses. <br /> <br />Mr. Swift presented the staff report to consider amendments to the "Defmitions" and <br />"Residential" sections of the Pleasanton Municipal Code to add "Secondary Units" as <br />conditionally permitted uses as the City has been doing for a number of years. This application <br />will actually change the Code to reflect past actions. <br /> <br />Commissioner Cooper inquired how the City would enforce the State law that the adult <br />occupants must be 62 years of age or greater. Mr. Swift advised that the City does not do this, <br />and that another section in the Code expands the occupancy of a secondary unit to any individual <br />of any age. <br /> <br />. <br /> <br />Commissioner Barker inquired if the definition should also include that the owner/occupier be <br />a signatory to the rental agreement. Mr. Beougher advised against adding that stipulation. <br /> <br />Mr. Swift advised that years ago there were discussions to change the ordinance on secondary <br />units when the State law was first enacted. No decisions were ever made, and no ordinance was <br />ever adopted. Staff has always made these decisions on a case-by-case basis. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />There were no speakers. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright motioned, seconded by Chairman Lutz, adopting a resolution <br />recommending approval of Case RZ-96-01 to the City Council as shown in "Exhibit A." <br /> <br />.
