Patco Enternrises <br />Application for rezoning from the A (Agriculture) District to the PUD (Planned Unit <br />Development) - MDR (Medium Density Residential) District and PUD Development Plan <br />approval for eleven clustered, single-family detached units on an approximately 1.66-acre lot <br />located at 4110 Del Valle Parkway. The proposal also includes construction of an 8'0" wide, <br />paved bicycle/pedestrian trail located in the Arroyo Del Valle from the Union Pacific Railroad <br />bridge to the existing trail-head located east of Main Street near Vervais Drive. The Planning <br />Commission will also consider the Negative Declaration prepared for the project. <br /> <br />Continued to June 26, 1996. <br /> <br />I. Modification to the Develooment Al!:reement for the Bernal Coroorate Park <br />Application for an amendment to the Development Agreement to extend the term by seven <br />years, from October 1, 1998, to October 1, 2005, for the Bernal Corporate Park (formerly the <br />Koll Center Pleasanton) located on the west side of Valley Avenue between Bernal Avenue and <br />the Arroyo del Valle. <br /> <br />Mr. Iserson presented the staff report on the application from Bernal A venue Associates for an <br />amendment to the Development Agreement to extend the term by seven years, from October 1, 1998, <br />to October 1, 2005, for the Bernal Corporate Park. <br /> <br />The nature of Development Agreements is to vest certain zoning, General Plan and other city <br />regulations at the time of approval, so the developer is assured that any changing ordinances, etc. <br />do to affect the development plan. <br /> <br />As part of this Development Plan, there was a requirement to pay park facilities fees. The applicants <br />agreed to pay the park fees at this time with the assurance that they would be able to extend their <br />Development Agreement. The City Council had no objection. Staff recommends approval of this <br />modification. <br /> <br />In response to Commissioner McGuirk, staff felt the applicants wanted to make the extension at this <br />time since they are making the park facilities payment at this time as well. <br /> <br />General discussion ensued regarding what park fees the applicant paid. <br /> <br />Commissioner Dove expressed his support of this application and staff recommendation. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />There was none. <br /> <br />PUBLIC l'RARTNG WAS n.o.l;lED <br /> <br />Commissioner Wright motioned, seconded by Commi!l.~ioner McGuirk, recommending approval <br />of the attached modification to the Development Agreement. <br /> <br />Planning Commission Minntes <br /> <br />Page 12 <br /> <br />Jnne 12, 1996 <br />
