.

.

.

In January 1996, McDonald's applied for a minor modification to the PUD sign program to allow
the installation of a "golden arches" logo sign. Staff approved the original sign which was 3 ft x
3.5 ft. A Planning Commissioner appealed this decision, therefore this major modification is before
the Commission. Subsequently the Hacienda Owner's Association approved the use of the 5 ft x 5
it logo sign.

Staff's opinion is that McDonald's is ancillary to the Wal-Mart and is to service the employees and
customers, not necessarily drive-by restaurant patrons. Further, they feel the signs do not need to
be as large as the Wal-Mart sign itself, more in size with the "service" signs. This is why staff
approved the 3 ft. size.

PUBLIC HEARING WAS OPENED

Robin Blackman, 2480 No. First Street, Suite 220, San Jose, is a real estate representative for
McDonald's. She provided the Commission with pictures of 5 foot McDonald logo signs on other
Wal-Mart stores. She asked the Commission to consider approving the five foot sign as approved
by the Hacienda Owners Association.

In answer to Commissioner McGuirk, Ms. Blackman advised that in other parts of the country they
sometimes use the name "McDonald's," however, in Northern California, they have found the
Golden Arch logo gets more approval.

PUBLIC HEARING WAS CLOSED

Commissioner Wright advised he cannot support this application further than approving the decals
on the entrance doors.

Commissioner Barker recommends denial of this application.

Commissioner Cooper stated he felt the 3 foot sign will have minimal impact and would support staff
recommendation.

Commissioner McGuirk feels the customers are Wal-Mart customers fIrst and McDonald's customers
second. He cannot support the proposed location of the sign and would rather see it placed where
the other service signs are located. He cannot support staff recommendation, and will deny this
application.

Commissioner Wright motioned, seconded by Commissioner McGuirk, denying approval of
Case PUD-85-8-5D-IM.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Dove, McGuirk, Wright, and Vice-Chairperson Barker
Commissioner Cooper
Chairman Lutz
None

Planning Commission Minutes

Page 11

June 12, 1996
