<br /> <br />. <br /> <br />Commissioner Wright noted that Conditions 2 and 9 require actions within 30 days of the <br />permit approval, without consideration that the eviction procedures may take longer than 30 <br />Il\\J~' He feel~ these conditions should be rewritten to include the eviction time frame. Mr. <br />Beougher feels that since the applicant has already started the eviction procedures, 30 days <br />would be sufficient. Mr. Iserson advised that to be conservative the Conditions could be <br />written to allow 30 days from approval or from the date that eviction occurs, whichever is <br />later. Regarding Condition 5, this condition cannot be used because of the alleged illegal <br />activities of the tenants. However, if these activities do cause complaints due to increased <br />traffic, noise, etc., staff can intercede with the applicant. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />No one represented this application. <br /> <br />Tiffany Tarver, 1144 Arak Court, stated she is tired of the problems associated with the <br />tenants of the neighboring second unit. She has no problem with the second unit as long as <br />Mr. and Mrs. Arakorpi are the decision-makers with respect to the future tenants. <br /> <br />Margo Tarver, 1144 Arak Court, stated that Pat McInerney is an absentee landlord, and <br />Mary Ellen Roche Arakorpi is in residence and would have a better sense of the daily <br />situation. They are surprised of how little protection they have against the activities of the <br />drug dealers. <br /> <br />. <br /> <br />Mr. Wright advised Ms. Tarver that the conditional use permit is conditioned that one of the <br />property owners has to live in one of the units. If one property owner moves out, the other <br />property owner would have to move in to be in compliance with the conditional use permit. <br /> <br />Paul Arakorpi, husband of one of the property co-owners (Mary Ellen Roche Arakorpi) <br />addressed the Commission. He stated he and his wife are in the process of buying out the <br />other sister's ownership of the property. Mr. Arakorpi also advised that he has informed his <br />sister-in-law (Pat McInerney) that all future tenants would have to be agreed upon by all <br />concerned before they will be allowed to live in the second unit. Mr. Arakorpi also stated <br />that the current tenants are in the process of moving out, and the eviction is based on the <br />tenants' narcotic activities. <br /> <br />In response to the Commissioners, Mr. Arakorpi does not know if Ms. McInerney has a <br />lease with the current tenant. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioners Barker, Hovingh, and McGuirk, and Chairman Lutz stated that they had <br />spoken with Ben Tarver regarding this application. <br /> <br />Discussion ensued regarding eviction processes. Commissioner McGuirk asked if the <br />application could be continued until after completion of the eviction.
