UP-94-24, Patricia McInernev <br />Application for a conditional use permit to establish a secondary unit within an existing <br />detached structure located at 1133 Arak Court. Zoning for the property is R-I-6,500 <br />(Single-Family Residential) District. <br /> <br />Mr. Otto presented the staff report on the application for a conditional use permit to establish <br />a second unit within an existing detached structure located at 1133 Arak Court. Mr. Otto <br />recapped the history of this structure. A building permit was issued in July 1976 to build a <br />detached garage; in November, 1988, a building permit was issued to convert the garage into <br />living space minus a kitchen (the addition of a kitchen required a use permit). However, a <br />kitchen was installed, making it an illegal second unit. Since March 1994, the applicant and <br />her sister (co-property owner) have been unable to agree on the use of the property. In <br />March, 1996, staff received a completed use permit application. During the interim, <br />however, the residents of the second unit had several narcotics-related problems with the <br />Pleasanton Police. The applicant is now attempting to evict these tenants. <br /> <br />Since the public noticing, staff has received complaints from surrounding residents <br />concerning the illegal activities of the tenants of the second unit. An illegal shed erected by <br />the second unit tenants will be removed once the current tenants vacate the property. <br /> <br />Staff feels the secondary unit meets the State requirements for secondary units as well as the <br />conditional use permit fmdings, and recommends the approval of Case UP-94-24, subject to <br />the conditions of approval. <br /> <br />Planning Commission Minutes <br /> <br />Page 4 <br /> <br />April 24, 1996 <br />
