Mr. Arakorpi stated the tenants are almost totally moved out, with only a few <br />l\ni..l~~ I~ml\ining in the unit. <br /> <br />Commissioner Wright believes that as a land use criteria, the applicants have met all the <br />requirements. The Commissioners are concerned about the amount of traffic generated by <br />the second unit and the impact on the neighborhood. Mr. Beougher advised that the past <br />history of the tenants cannot be held against this application at this time. <br /> <br />Commissioner Barker and Chairman Lutz are in favor of continuing the application. <br /> <br />Commissioner Barker motioned to continue Case UP-94-24 until May 8, 1996, on the <br />basis to ("md out if the owner is actually leasing the property. The motion died for lack <br />of a second. <br /> <br />Mr. Beougher advised that with co-owners, they both own the property 100 percent and <br />either one can lease the property without approval of the other. <br /> <br />Commissioner Wright motioned approving Case UP-94-24, subject to the conditions <br />listed in Exhibit B, with the following modification: <br /> <br />Conditions 2 and 9: Staff to add tenant eviction along with the 30 day time <br />period. The motion died for lack of a second. <br /> <br />Mr. Beougher advised the Commission could continue the application if they had a sufficient <br />basis for doing so. <br /> <br />Commissioner Wright restated his motion: <br /> <br />Commissioner Wright motioned, seconded by Commissioner McGuirk, making the <br />Conditional Use Permit findings and approving Case UP-94-24, subject to the conditions <br />of approval in Exhibit B, with the following modifications: <br /> <br />Conditions 2 and 9: Change "thirty (30) days from the date of project approval" <br />to "thirty (30) days and/or tenant eviction, whichever is greater." <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Hovingh, McGuirk, Wright and Chairman Lutz <br />Commissioner Barker <br />None <br />None <br /> <br />Resolution No. PC 96-24 was entered approving Case UP-94-24, as motioned, <br /> <br />Planning Commission Minutes <br /> <br />Page 6 <br /> <br />AprU 24, 19% <br />
