<br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />. <br /> <br />l\-vv;n Li~J .~.. cvon~ IWIlll, ~pol\e on behalf of the Tri-Yalley Chine~e Bible Church. The <br />Church would like to have an unconditional approval of the 10:30 p.m.. time, but if that is <br />not granted, they desire the 10:30 p.m. probationary arrangement. They want to be good <br />neighbors to all concerned and are aware of the potential noise problem. Mr. Liu feels the <br />probationary arrangement will provide a sufficient time period to closely monitor the <br />situation and opportunity for the neighbors to voice their concern during that period. <br /> <br />Granting this conditional use permit will allow the Church to significantly improve their <br />Friday night services. Mr. Liu stated the Church contacted the neighbors soon after they <br />moved in, and they have never received any complaints or concerns from the neighbors. <br />Mr. Liu feels there will be no problem clearing the premises by 10:30 p.m. since they have <br />been doing so to meet the 9:30 p.m. requirement. <br /> <br />Commissioner Wright asked if they would use both of the rear doors. Mr. Liu stated one <br />door would suffice for ingress/egress. Another reason for using the rear doors would be for <br />convenience to the trash dumpster. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh commented that he feels this is the same principle as the situation of <br />the Hopyard Village Shopping Center and they must be sensitive to the neighbors; however, <br />. he is satisfied with the staff report and recommendations. <br /> <br />Commissioner Wright commented he would agree to the extension to 10:30 p.m. on a three- <br />month probationary period and feels they have complied in being good neighbors because no <br />neighbors have initiated a complaint. He would also approve of using one rear door during <br />the same hours. <br /> <br />Commissioner McGuirk stated he would rather approve the 10:00 p.m. time limit. If there <br />are no problems in the future, the Church can come back for the 10:30 p.m. time limit. <br /> <br />General discussion centered on noise issues, whether the time should be set at 10:00 p.m. or <br />10:30 p.m., and whether the rear doors could be used for garbage removal and Church <br />member ingress/egress. <br /> <br />Commissioner Barker stated she would approve of the 10:30 p.m. probationary period, but <br />would not approve of use of the rear doors during the night time. <br /> <br />Commissioner Dove feels that the summer time will not provide a good test and suggested a <br />six-month probationary period would provide a better test. <br /> <br />Chairman Lutz supports the 10:30 p.m. probationary period; however, he is hesitant in <br />opening the doors during the night. <br /> <br />. <br /> <br />Planning Commission MInutes <br /> <br />Page 3 <br /> <br />April 24, 19% <br />
