UP-95-81, HEC Investments (24-Hour Nautilus) <br />Application to modify an approved conditional use permit to allow utilization of health <br />club facilities on a 24-hour basis, Monday through Friday, and 7:00 a.m. to 11:00 p.m., <br />Saturday and Sunday, located at 5860 West Las Positas Blvd. Zoning for the property <br />is PUD (Planned Unit Development) - I/C-O (Industrial/Commercial-Office) District. <br /> <br />Mr. Iserson presented the staff report on the application from 24-Hour Nautilus to amend <br />their conditional use permit to extend business hours to 24 hours on weekdays, and 7:00 a.m. <br />to 11:00 p.m. on weekends. No other elements of the conditional use permit will be <br />changed (no increase in employees, membership, physical expansion/remodeling). In an <br />attempt to mitigate impacts to the residents directly across the arroyo, there is an existing <br />condition restricting parking before 8:00 a.m. and after 5:00 p.m. to the front portion of the <br />site and to the eastern side of the building as far down as the aerobics room door. A <br />proposed condition would limit parking to in front of the building only between the hours of <br />11:00 p.m, and 6:00 a.m. <br /> <br />Staff has not received any complaints from the neighbors, and staff inspections indicate the <br />existing conditions are being honored. The Hacienda Owner's Association shared staff's <br />concern about possible impacts on the adjacent neighborhood. They are willing to support <br />this application subject to the conditions of approval. Therefore, staff recommends approval <br />of Case UP-95-81, subject to the conditions listed in Exhibit B. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mike Feeney, 21 Castleford, Danville, representing 24-Hour Nautilus and this application, <br />stated they agree with the staff report and conditions of approval.
