Also, they cannot foresee that there would be any nuisance problems with these II uses. <br /> <br />William Stephens, 2793 Longspur Way, is across Longspur from the subject property, but is <br />situated such that his home receives the light glare. He would not want to turn off all <br />lighting in this area because of security concerns. He is in favor of keeping the gate hours <br />as they are. Mr. Stephens noted that city ordinance allows a leaf blower to operate until <br />10:00 p.m., and this has not been addressed in these modifications. He wants to keep the <br />noise level down and keep their property values up. Regarding the "authorized persOlmel," <br />he questioned who would be the authorizing body, and does not believe the employees <br />cleaning out the Popi Lounge would be considered "authorized personnel." He only wants <br />security personnel to be allowed to control the gate. <br /> <br />Chairman Lutz noted that Condition IB needed the restriction "and after 7:30 p.m." added. <br /> <br />Elizabeth Stephens, 2793 Longspur Way, advised that their property values have been at risk <br />to a great extent because disclosure laws require homeowners to disclose the shopping center <br />problems. These issues are detrimental to them. <br /> <br />. <br /> <br />Erin Busby, 5725 Valley Ave., Director of La Petite Academy, is thankful that the neighbors <br />are being accommodated. They have changed several of their operations to comply with <br />neighbor complaints. They are concerned about the safety issues relating to the lack of <br />lighting, and they've had several incidents of falling and twisted ankles. Ms. Busby is also <br />concerned about when the lights will be turned back on in the morning. It is usually very <br />dark at their 6:00 a.m. opening. <br /> <br />Ms. Busby does not take issue of the gate closure hours, however, the children walking <br />through the parking lot will be much noisier. She also is agreeable to the security personnel <br />having the keys, however, they have failed to unlock the gate at the posted hours. <br /> <br />Rev. Ron Hunt, 2790 Longspur Way, was supportive of the daycare business to get low-level <br />lighting after the roof-mounted lights were turned off. He recapped the history of the center <br />and whether Building 5 was office use only or mixed uses. He stated that living there has <br />been "unbearable" at times. Rev. Hunt would like Building 5 be reverted to the original <br />zoning of office use only as agreed upon by the center owner, staff and neighbors. <br /> <br />Regarding the taillight standard and the landscaping, Rev. Hunt learned the mature bushes <br />are only 2-3 feet tall and will take some years to be of any benefit from eliminating the <br />parking lot lighting.
