Regarding staff's changing permitted uses 10 <br />conditional uses, Mr. Gade feels it is in their best interest to still push for office use only for <br />Building 5. Regarding the landscaping, they prefer larger, more mature landscaping be <br />planted than what is proposed. <br /> <br />Ty Shettron, Northwest Asset Management, 300 Orchard City Dr., #107, Campbell, <br />represented the shopping center owners. The office use only restriction for Building 5 is <br />unacceptable and financially infeasible for this building. They would like to add back 11 of <br />the 51 deleted uses. <br /> <br />Regarding Condition lC, Mr. Shettron asked for direction on the No Trespassing signs to be <br />erected and asked that "and other authorized personnel" be added to the sign. <br /> <br />Condition IE, time of lighting. The property owners are not able to restrict public access <br />(foot traffic) to the back parking lot, and they would ask for an extension of the 7:30 p.m. <br />shut -off time because of their concerns for liability. They have gone to great lengths to <br />shield any glare from the residences and feel this will not be an issue to the neighbors. <br /> <br />Commissioner Hovingh asked the speaker if he would agree to restricting business hours to <br />7:30 p.m. in Building 5 in exchange for the 11 additional uses requested. Mr. Shettron feels <br />this restriction would not be constitutional. Chairman Lutz stated such a restriction would be <br />a condition of the PUD and an acceptable restriction. Mr. Beougher agreed. <br /> <br />Commissioner Wright does not agree to the speaker's concern of liability and is of the <br />opinion that leaving the parking lot light on past 7:30 p.m. would be an inducement to <br />skateboarders. The bollard lights and building lights would provide enough visibility on the <br />sidewalks. He agrees to the addition of "other authorized personnel" on the sign, and feels <br />the 24-inch box tree is a mature tree. <br /> <br />Thomas Cave, 150 Almaden Blvd., #1375, San Jose, spoke to their liability issues. There <br />were roof-mounted lights, which have been turned off some months ago due to neighbors' <br />complaints. Requiring the lights be turned off at 7:30 p.m. is of great concern. He <br />proposed a middle ground to turn off the light standard at 9:00 p.m. and continue the light <br />bollards all night. Mr. Cave feels there will be some authorized people in this area <br />(employees of Popi Lounge and La Petite Academy janitors). Mr. Beougher advised that <br />staff wishes only 15 ft. parking lot light standard be turned off at 7:30 p.m. The bollard <br />lighting would continue to stay on. <br /> <br />Mr. Cave spoke to Building 5 and office uses. The Manulife owners are very concerned <br />about the 7:30 p.m. business hours restriction.
