<br />. <br /> <br />. <br /> <br />. <br /> <br />Commissioner Hovingh commented that he would pursue a reduction in the size of the monument <br />signs to match the dimensions in the previous application. He would also like to remove the <br />south wall sign. Mr. Dai responded that the proposed signage size is within the Hacienua Sign <br />Guidelines; given the area of the land, he does not feel the sign is too large. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh spoke about his concern for air quality and car emissions with regard to <br />drive-through windows. He inquired if there should be a condition stating that the drive-through <br />window be closed at times of poor air quality. Commissioner McGuirk basically agreed with <br />Commissioner Hovingh, but disagreed that such a condition should be added to this particular <br />application. Commissioner McGuirk feels this would be better addressed in an ordinance. Staff <br />added that the studies regarding dtive-through windows and air quality have no clear-cut <br />conclusions; the latest study completed for the General Plan indicates that drive-throughs may <br />actually cause less air pollution than stopping and restarting cars for walk-in customers. <br /> <br />Discussion ensued regarding Commissioner Wright's personal dislike for drive-through windows <br />and inquired if he should abstain or vote no on the application. Mr. Beougher advised that he <br />does not have to give any reasons for a "no" vote. Commissioner Wright stated he would not be <br />supporting the application, based Oil his personal dislike for drive-throughs and because of Arby's <br />lack of success in Dublin. <br /> <br />Chairman Lutz commented that it is not clear to him that drive-through windows are any worse <br />than cold starts of engines at regular walk-in restaurants. He also feels the City Council has <br />stated the Commission should consider applications based on the General Plan as it exists now, <br />not the draft update. <br /> <br />Commissioner McGuirk motioned, seconded by Commissioner Barker, making the use <br />permit findings and recommending approval of Case PUD-81-30-61D and UP-96-02 subject <br />to the conditions listed in Exhibit B, with the following modifications: <br /> <br />Condition 16: <br />Condition 70: <br /> <br />as stated by staff. <br />Staff to review the Chabot driveway to enhance the safety <br />features and bulb out as determined by staff. <br /> <br />ROLL CALL VOTE <br />AYES: Commissioners Barker, McGuirk, and Chairman Lutz <br />NOES: Commissioners Hovingh and Wright <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Commissioner Hovingh stated he could not make Finding B for public health and safety, <br /> <br />Resolution No. PC-96-09 was entered approving Case PUD-81-30-61D and UP-96-02, as <br />motioned. <br /> <br />Planning Commission Minutes <br /> <br />Page 5 <br /> <br />February 14, 1996 <br />
