The applicants will install six bike racks (a <br />memo distributed to the Commissioners revises Condition 8 giving the applicants 30 days <br />after commencement to install the bike racks). <br /> <br />The operators will monitor computer use such that school children will not be allowed <br />computer time during school hours. <br /> <br />Parking was discussed, and staff feels that one space per work station and one space per <br />employee would be sufficient. Also, the peak business time would be the evening hours <br />when other businesses are closed. Therefore, staff feels there is a sufficient amount of <br />parking available. <br /> <br />Staff recommends approval of Case UP-95-83 subject to the conditions of approval. <br /> <br />Commissioner Hovingh commented on the 10 p.m. City curfew. General discussion <br />followed regarding curfew and what constituted a violation of the curfew. Mr. Beougher <br />advised that there would be a technical violation of curfew when teens are out after 10 p.m., <br />however, the police do not enforce curfew violations unless there is a problem. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Brett Halle, 4867 Valley Avenue, advised that he is in general agreement with the staff <br />report and conditions of approval. <br /> <br />Commissioner Hovingh inquired if the applicant would be opposed to a 9:45 p.m. time limit <br />for teenagers. Mr. Halle did not think it a problem except for the logistical problem of the <br />time allocations used for the computer time. <br /> <br />Commissioner McGuirk inquired if the users would be able to download their own software <br />or copy the store's software. The applicant stated that the floppy drives and CD ROMS are <br />covered so that patrons cannot use their own disks, etc. There is a printer in the store. <br /> <br />Jeanne Faderres of the Sylvan Learning Center stated she has spoken with the applicants <br />regarding the type of computer usage accessible to children. She is not opposed to the <br />applicant's business. She does not feel that there is a conflict with her patrons' tutoring. <br /> <br />The speaker stated the parking lot lighting is poor for a night-time center, and would be <br />interested in installing speed bumps to curb traffic speed. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />In response to Commissioner Barker, staff noted the City could contact the property owner to <br />improve the lighting situation.
