MATTERS CONTINUED FOR DECISION

There were none.

6. PUBLIC HEARINGS

a. UP-95-75. Svlvia D'Anl!elo
Application for a conditional use permit to establish a second-hand clothing store for
consignment sales located at 3876 Old Santa Rita Road. Zoning for the property is
PUD (Planned Unit Development) - C-S (Commercial Service) District.

Mr. Iserson presented the staff report for an application for a conditional use permit to
operate a second-hand clothing consignment store at 3876 Old Santa Rita Road. The store
site is an old residence previously used for office purposes. There are two automotive
businesses located to the rear of this building, separated from the subject store by cyclone
fencing. There will be no changes made to the building. This is a small-scale operation
with no need for truck traffic.

Staff feels this is an acceptable land use. Mr. Iserson advised that a revised Condition No.2
has been distributed to the Commissioners before the meeting. The applicant desires to
operate on Saturday, however, the cyclone fence gate would not be open on Saturday,
inhibiting traffic circulation for parking purposes. Unless the applicant wishes to move the
gate and fencing back or make arrangements for the gate to be open on Saturdays to allow
for safe circulation, staff recommends the business hours be confmed to Monday through
Friday. On that basis, staff recommends approval of Case No. UP-95-75 subject to the
attached conditions of approval and the revised Condition No.2.

Commissioner Hovingh inquired if the applicant could be allowed to be open on Saturday
with restricting parking to on-street parking. Mr. Iserson stated there is a requirement for
off-street parking for customers. Also, the curbing in front of the business is painted red.
However, he believes that the red curbing may be able to be reverted back to regular
curbing. Staff feels it is important to have a few on-site parking spaces.

PUBLIC HEARING WAS OPENED

No one represented this application.

Planning Commission Minutes

Page 2

January 24, 1996
