<br />Commissioner Hovingh concurs with Commissioner Barker and feels this change could <br />. potentially evolve into neighborhood degradation. He will not support the Code change. <br /> <br />Commissioner McGuirk feels the same, seeing no reason to increase the hours of alcohol <br />availability in the neighborhood centers. He sees no internal ordinance enforcement after <br />10:00 p.m. No realistic City enforcement is available except after the fact/problem, as they <br />may occur. He would place enforcement of the ordinance change on the benefactors, not on <br />the residents. <br /> <br />General discussion ensued regarding the fact that the conditions are so stated and any <br />complaint to staff by the neighbors would be addressed and that homeowners don't want to <br />be the neighborhood police always having to report problems. <br /> <br />Chairman Lutz can support the Code change with the addition of conditions prohibiting <br />amplified music and game machines. <br /> <br />Commissioner Hovingh motioned, seconded by Commissioner McGuirk, denying <br />approval of Case RZ-96-6 to the City Council. <br /> <br />ROLL CALL VOTE <br /> <br />. <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Hovingh, McGuirk <br />Commissioner Wright and Chairman Lutz <br />None <br />None <br /> <br />Resolution No. PC 96-02 was entered denying approval of Case RZ-95-6, as motioned. <br /> <br />It was noted that the applicants can appeal the Planning Commissions decision to the City <br />Council with fifteen days. Commissioner Wright requested the staff report include that he <br />and Chairman Lutz would request that there be no amplified music, no gaming machines, <br />and possibly no large-screen TVs. <br /> <br />c. PUD-81-30-59D. Parkview (A.G. 8oanos Corooration) <br />Application for Planned Unit Development development plan approval to construct a <br />two- and three-story, 462-unit apartment complex on an approximately 20-acre site <br />located at 5700 Owens Drive (south side of Owens Drive between Rosewood Drive and <br />Tassajara Creek).
