<br />. <br /> <br />. <br /> <br /> <br />. <br /> <br />Staff is recommending approval of RZ-95-6 by the Planning Commission to the City <br />Council. <br /> <br />Commissioner Barker inquired why staff is making a global change to the Code instead of <br />changing the zoning for the Oak Hills shopping center (who is seeking the modification). <br />Mr. Iserson stated the shopping center is zoned as C-N (not a PUD), therefore, any changes <br />would apply to all C-N districts. Mr. Iserson noted that staff did not feel the applicant <br />needed to propose a PUD rezoning and create a list of special uses for the Center. <br /> <br />Commissioner Wright clarified that Rod's Hickory Pit could continue their operation as is <br />(with a separate bar area) at the Oak: Hills Shopping Center, if they discontinued serving <br />alcohol at 10 p.m. <br /> <br />General discussion ensued with staff regarding the concept of the full dinner menu being <br />available while alcoholic beverages are being served. Mr. Iserson stated the implied intent <br />of the Code was that the restaurants would prepare the food after 10 p.m. just as they <br />prepare the food during the normal dinner hours. Staff stated that the Commission could add <br />to the Code or add as conditions to the conditional use permits that drinks cannot be served <br />unless accompanied by a meal. <br /> <br />Further discussion ensued regarding past problems with bars and music and dancing <br />establishments in retail centers. Commissioner Hovingh suggested an addition be made that <br />no amplified music be permitted after 10 p.m. <br /> <br />It was also noted that this change to the Code would impact several restaurants in Pleasanton, <br />one or more in every shopping center. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Stuart Snider, 120 Main Street, #G, Sacramento, leasing agent for Oak: Hills Shopping <br />Center, represented their application for a Code modification. He stated their goal is to <br />allow higher quality sit-down restaurants to locate within their type of shopping center and be <br />able to serve alcohol later into the evening. They are in agreement with staff's criteria for <br />the Code change. They do not intend to have bars or nightclubs locate in C-N districts. In <br />response to Commissioner Hovingh, Mr. Snider feels any restaurant should offer a good faith <br />attempt to serve all menu items after 10 p.m. <br /> <br />In response to Chairman Lutz, staff further clarified that their intent in changing the Code <br />was that after 10 p.m. any restaurant would have to offer a full dinner menu to all patrons. <br />It is the patron's choice to order a meal, with or without alcohol, or order alcohol only. <br /> <br />In response to ('.()l:I1mi....ioner Barker.
