RZ-95-06. Pleasanton C&R Associates/Connollv Development <br />Application to amend the definition of a "bar" as stated in Section 18.08.027 of the <br />Zoning Ordinance and to modify Table 18.44.090 (Permitted and Conditional Uses of <br />Commercial Districts) to allow restaurants in Neighborhood Commercial zoning districts <br />to sell alcoholic beverages after 10:00 p.m. upon approval of a conditional use permit. <br /> <br />Mr. Iserson presented the staff report on the application by the Connolly Company <br />requesting a change to the Municipal Code to allow restaurants located in C-N Neighborhood <br />Commercial districts to be able to serve alcohol after 10 p.m. The Code defines any <br />establishment serving alcohol after 10 p.m. as being a "bar," and does not allow a "bar" to <br />be located in the C-N Neighborhood Commercial districts. At this time, therefore, any <br />establishment in the C- N districts selling alcohol must either discontinue the sale of alcoholic <br />beverages or close at 10 p.m. <br /> <br />The Connolly Company has been in discussions with Rod's Hickory Pit who would like to <br />relocate to the Oak Hills Shopping Center. <br /> <br />Staff is sensitive to the standards and criteria regarding the type of businesses and the sale of <br />alcohol located in C-N districts because they are so close to residential areas. <br /> <br />Staff also felt there are ways to protect the objectives and purposes of the C-N district and <br />allow the sale of alcohol after 10 p.m. Staff is proposing that restaurants be able to serve <br />alcohol after 10 p.m. with the following conditions: <br /> <br />- A full dinner menu be available after 10 p.m. <br />- Sale of alcohol must end at 12 midnight. <br />_ There be only a single access door to serve both restaurant and lounge/bar area. <br />_ There be no partitions or walls separating the restaurant from the lounge area. <br />_ The floor area devoted to a lounge area be no more than 25 % of the total gross <br />floor area. <br /> <br />Staff noted that they received a letter from Mr. John Wiley, 634 Palomino Drive, who has <br />expressed concemreJ8Iding the proposed Code change as well as telephone discussions with <br />several obr neighbOrs. <br />,.
