He also addressed the v-gutter drainage <br />along some of the rear property lines. He pointed out that staff's condition 2b requires the <br />developer to mitigate the v-ditches by combining them with adjoining neighbors, if possible. <br />The developer has agreed to this condition as long as their liability is not increased and the <br />neighbors share in the pro-rated cost. <br /> <br />Mr. Costanzo also addressed the NSSP requirement for a 75 foot setback that occurs along "A" <br />Street. The developer originally designed the site plan where the homes range from 55 to 70 feet <br />back; however, they have asked staff to consider reducing that range an additional 10 feet in <br />order to allow for larger back yards. He noted that this change would still accommodate the <br />traffic and noise issues that have previously been identified and requested the Commission's <br />support on the issue. <br /> <br />Mr. Costanzo noted that the developer has agreed to comply with staff's Alternative B in <br />removing the road from Mr. Kass' property. <br /> <br />As was pointed out in the staff presentation, Mr. Costanzo confirmed that Greenbriar has <br />attempted to work diligently on all issues raised by the neighbors. Mr. Costanzo identified the <br />agreements that had been made with particular neighbors and the issues that have not yet been <br />resolved. <br /> <br />Mr. Costanzo also presented a layout of the proposed "A" Street and described its objectives and <br />some alternatives that the developer and staff have suggested. He noted that there are some <br />major differences between staff's and the developer's positions on several issues relating to "A" <br />Street. <br /> <br />Mr. Costanzo stated that the developer would like to have condition 21 modified to allow for <br />a landscaping and lighting district, if they could resolve this issue with the City Attorney. He <br />described various ways that Greenbriar's attorneys have indicated how such a plan could be <br />established, despite Proposition 218. <br /> <br />Finally, Mr. Costanzo addressed the finance plan and stated that since Greenbriar is the first <br />funding developer in the NSSP, they have had to create a fInance plan which provides a way for <br />the extensive infrastructure to be funded. He noted that the total cost is in the area of $9 <br />million to $10 million. He pointed out that the plan listed items that should be shared between <br />funding developers and the City. Most of the items have been agreed upon, and the developer <br />is hopeful of resolving the remaining issues. <br /> <br />Mr. Costanzo distributed a summary to the Commission identifying the developer's proposed <br />modifications to staff's recommended conditions of approval. <br /> <br />Planning Commission Minutes <br /> <br />Page 9 <br /> <br />November 19, 1997 <br />
