'\' 1\

Smff has also expressed concern with the lack of a stonn water system for the temporary lot and
has suggested that the paving be done in way which would allow the storm water to run off
toward the street, which has a stonn water collection system.

Mr. Iserson stated that the proposed tent is off-while and is the same tent that the applicant has
used the past few years. He noted that the applicant plans to illuminate the tent and dining area
again this year and staff believes
it presents a festive appearance for the holiday season.

Mr. Iserson suggested that when the applicant appears before the Commission on her application
for the pennanent parking lot, that the Commission consider giving her pennission to erect the
tent each year. He stated that smff recommends approval of the application, subject to the
conditions listed in Exhibit "B" to the smff report.

Commissioner Kumaran asked who was responsible for insuring the safety of the tent structure.
Mr. Iserson responded that the Building Department and Fire Department will inspect the tent
to be sure it meets the codes.

PUBLIC HEARING WAS OPENED

The applicant, Maricela Barone, 493 St. John Street, smted that she agreed with Mr. Iserson's
summary. She confinned that due to other financial commitments, she was unable to construct
the pennanent parking lot as was directed by this Commission last year. She emphasized that
she intends to build the pennanent parking lot next Spring.

PUBLIC HEARING WAS CLOSED

Commissioner Lutz smted that he will support the application, but he does not want to review
the tent issue again unless the applicant follows the Commission's instruction in building the
pennanent parking lot by next Spring.

Commissioner Wright agreed with Commissioner Lutz and, therefore, will support the
application.

Commissioner Barker supports the application and agrees that the temporary parking lot is
needed.

Commissioner Kumaran noted that his concern regarding safety had been satisfactorily
addressed, and he is in support of the application.

Chair Cooper stated that he is in support of granting the application for the temporary parking
lot and the tent, but he agreed with the other Commissioners that the parking lot situation needs
to be resolved.

Planning Commission Minutes

Page 3

November 12, 1997
