Mr. Swift described the proposed site improvements <br /> <br />and building modifications which include the installation of two roll-up doors and an exhaust vent <br />for the spray booth. Mr. Swift advised that staff is recommending approval of the conditional <br />use permit and the design review subject the conditions of the staff report. <br /> <br /> <br />In response to a question from Commissioner Kumaran, Mr. Swift advised that the spray paint <br />booth will require Building Department permits, as well as Fire Department permits. He noted <br />that staff does not feel there will be any health implications to surrounding residents. <br /> <br />Chair Cooper inquired as to how the applicant would dispose of paint. Mr. Swift advised that <br />the applicant would need to comply with the City's ordinance related to the disposal and storage <br />of materials. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Gernot Sehmsdorf, 1400 Wagoner Drive, Livermore, represented the application for the <br />conditional use permit. He stated that he has reviewed the conditions with staff and has no <br />problem with them. In response to a question from Chair Cooper, he advised that the floor of <br />the building is a concrete slab and that there is no floor drain. He reported that paint and <br />thinners would be placed in containers and disposed of. Mr. Sehmsdorf stated that he is a <br />considerate and solutions-oriented person and if any issues arise he would deal with them. He <br />noted that Mr. Martinez has already spend a lot of time and effort and money in making <br />improvements to the site. <br /> <br />. <br /> <br />Leonard Nolting, 233 Prospect Avenue, Danville, stated that he is Mr. Martinez' attorney. <br /> <br />Guillermo Martinez, owner of Martinez Concrete, 3920 Old Santa Rita Road, stated that he has <br />been leasing the property for three years. He noted that he has brought the existing businesses <br />located on the site into compliance with the City's rules. He stated that he agrees with the <br />conditions of approval, noting that he has been cleaning up the site and adding landscaping. <br /> <br />Cari Grooms, 2944 B Old Santa Rita Road, stated that she lives in one of the residences next <br />door to the site. She expressed concerns about potential noise that could be caused by the <br />woodworking/cabinet shop, noting that the shop is a tin shed which is about 20 to 30 feet high. <br />She stated that she is curious as to how it will be vented. She clarified that there are four single- <br />family homes next door and that the units were never a motel, as stated in the staff report. She <br />agreed that Mr. Martinez has cleaned up the site. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Dove expressed concern about the painting. He suggested that condition 13 be <br />modified to include the word "odor."
