He noted that the secondary access <br /> <br />on Owens aligns with the AT&T driveway across the street and that the volume of traffic is lower. <br />Commissioner Cooper stated he is concerned about the safety of this situation. <br /> <br />Commissioner Kumaran commented that he supported the wavier of the lower-income housing fee, <br />but felt that the additional waiver of the other City fees totaling $2.1 million would result in a <br />negative impact to the General Fund and questioned the outcome of the economic analysis. Mr. <br />Iserson noted that the project would generate property tax, as well as sales tax for the City. <br /> <br />Commissioner Lutz inquired about the correspondence stating that two burrowing owls were seen on <br />the site. Mr. Iserson noted a situation in another area of the Hacienda Business Park where burrowing <br />owls habitated. He advised that in that situation the developer could not grade during the nesting <br />period. He noted that the Commission could add a condition such as this or one requiring a study <br />be conducted. <br /> <br />In response to a question from Chair Barker, Mr. Iserson provided clarification regarding the proposed <br />density of the project. Chair Barker noted that she felt the waiver of fees in the amount of $2,900 <br />per unit for a total of approximately $1.5 million was very high for a three-acre undeveloped park. <br />Mr. Iserson clarified that the park would be dedicated and the applicant will be paying the difference <br />in park in-lieu fees. <br /> <br />Marty Wadekamper, Chair of the Affordable Housing Commission, reiterated the basis for the <br />Affordable Housing Commission's recommendation that the fee waiver be granted, noting all units <br />must be completely the same and evenly dispersed throughout the project. She noted that any changes <br />from this criteria will be conditioned to go back to Council. When asked about the process used to <br />make the waiver determination, she advised that the Commission followed staff recommendation and <br />that Mr. Scott Erickson, Housing Specialist, would be able to answer any questions regarding the <br />Commission's recommendation for approval. She advised that she was attending the Planning <br />Commission meeting in the spirit as a liaison. <br /> <br />Mark Sweeney, 4309 Hacienda Drive, represented Prudential Insurance Company of America, the <br />property owner and co-applicant. He advised that the applicants have worked closely with staff and <br />the residential neighbors in developing the proposed project. He noted that the project includes in <br />excess of 12 acres of park land and that the Park and Recreation Commission supported unanimously <br />the proposal for the park land. He provided a history of the original rezoning of the property and <br />previously proposed projects, as well as the park land issue. He noted that the applicant would <br />receive a credit for the park land and the balance will be paid in in-lieu park fees. He advised that <br />the property is already burdened by bond indebtedness and has already paid for substantial capital <br />improvements. He advised that he believes Signature Properties is conditioned to build the park. <br /> <br />Mr. Sweeney commented that left turns in Hacienda Business Park have not historically created <br />problems and that the entrance to Avila only allows left turns into the development, and that left-turns <br />cannot be made coming out of the development. <br /> <br />Shyam Taggarsi, 22320 Foothill Boulevard, #220, Hayward, represented Security Capital Pacific <br />Trust. He provided background regarding Security Capital Pacific Trust, noting that the company has <br />its own management company.
