<br />Tony Macchiano, represented Pleasanton Garbage Service. He informed the Commission that the site <br />has been closed as a land fill site and that it would be up to the City to determine whether the site <br />could be used as a future park. He also advised that the area will be hydro seeded prior to the rainy <br />season. <br /> <br />. <br /> <br />Don Cotton, 710 F oxbrough Place, asked the Planning Commission to reject the application. He stated <br />that he was having a difficult time determining where the fill will be placed, in that the area appears <br />to be outside the fenced land fill area. He also expressed concern about the project being actively <br />managed. He note that there has been grading done without notice to the neighbors. He expressed <br />concern regarding fill that has already been placed around existing trees. He also reported that there <br />is currently a problem with the storage of containers on the property. Mr. Cotton reiterated that he <br />would like the Planning Commission to reject the application, in that there is a need to understand <br />more fully about the boundaries and height of the fill, and the problem with the oak tree and storage <br />of containers is addressed. <br /> <br />Janet Cotton, 710 Foxbrough Place, requested that the Planning Commission reject the application <br />until the issues could be more fully reviewed. She stated that she would like to see the area staked <br />and the height of the fill indicated. She also noted that a neighbor currently on vacation also opposes <br />the application. <br /> <br />In response to an inquiry by Commissioner Cooper, Ms. Watt stated that the property was annexed <br />in 1993 and that the Pleasanton Garbage Service's storage on the site prior to annexation met the <br />County's requirements. She noted that the green waste cans which are located on the site should have <br />been removed. <br /> <br />. <br /> <br />In response to a question from Commissioner Kumaran, Ms. Watt reported that it had been difficult <br />to correlate the stakes on the site because the property lines are not in accordance with the fence lines. <br /> <br />Mrs. Stice commented that the drainage issue is addressed in the conditions of approval. He also <br />reported that with regard to monitoring the placement of fill, the City staff is at the site on a <br />day-to-day basis to insure everything is done appropriately. He noted that with regard to the storage <br />of containers, Pleasanton Garbage Service is not the applicant, and that Signature Properties has no <br />control over PGS storing containers. He pointed out that the scope of the use permit is just for the <br />placement of surplus fill. <br /> <br />Chair Barker asked if there is an opportunity to conduct a more thorough walk-through. Ms. Watt <br />noted that it would be possible to stake the limits of the fill site and that she would encourage the <br />applicant to do so. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Cooper expressed concern with the application. He advised that he sympathizes with <br />the homeowners. He noted concern with Pleasanton Garbage Service violating existing permits and <br />that the issue of the storage of containers does not show good faith. He sees that the placement of <br />fill on this site is being done just to save Signature Properties the cost of relocating the fill to a <br />different site farther away.
