Chair Barker expressed her agreement with Commissioner Cooper. She advised that she spoke with
Mrs. Cotton today and that as long as there is questions and concerns by the neighbors, she could not
support the application.

.

Commissioner Wright noted that the applicant is not Pleasanton Garbage Service. He sees Signature's
application separate from the issues involving PGS, and that he views the proposal as a normal
request.

Commissioner Kumaran stated that he sees the application as a request to relocate dirt from the
S-curve project. He believes that staff has done its work and that the conditions provide assurances
for the neighbors.

Commissioner Lutz stated that he feels there are enough safety features in the conditions of approval
for monitoring and carrying-out the work. He noted that he supports the temporary storage of the fill
but that this does not indicate a future use or amenity on the site or approval of permanent placement.

A motion was made by Commissioner Wright, seconded by Commissioner Kumaran, making
the conditional use permit findings and approving Case UP-97-51, subject to the conditions
listed in Exhibit"B."

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Kumaran, Lutz, and Wright
Commissioner Cooper and Chair Barker
None
None

.

Resolution No. PC 97-69 was entered and adopted approving Case UP-97-51 as motioned.

Commissioner Cooper noted that this decision is appealable to the City Council.

d. City of Pleasanton
Consideration of a PUD modification for land use alternatives for the structure commonly known as
the Bernal Adobe located at 1780 Foothill Road to residential and non-residential uses.

Mr. Iserson presented the staff report noting the history of the application for the use of the Bernal
Adobe as a special events center. He reviewed the three possible reasonable alternative uses for the
building: special events center (day use only), residential use, and bed and breakfast inn. He noted
that staff has contacted the neighbors and that the residential use is preferred. One of the issues
related to the residential use is whether the residence would be required to annex to the homeowners'
association. He noted that the owner does not wish to be part of the association. Mr. Iserson noted
that conditions of approval have been provided for each of the alternative uses.

PUBLIC HEARING WAS OPENED

.

Patrick Currin, 8272 Sassafras Court, represented the property owner.
