PUD-97-10. Silver Bear. Ltd. <br />Application for Planned Unit Development rezoning and development plan approval for a 1,920 <br />square foot barn (for agricultural use) which is 23 feet in height, located at 1364 Vineyard <br />Avenue. Zoning for the property is PUD (Planned Unit Development) - RDR (Rural Density <br />Residential) District. <br /> <br />Mr. Swift presented the staff report recommending approval of Case PUD-97-1O, subject to the <br />conditions of the staff report. He explained that the site is located in the area between Ruby Hill and <br />the City limits which was annexed in 1993. He advised that the City adopted some interim <br />guidelines for additions to existing residences and other small structures within the existing properties <br />without requiring a full development plan. He noted that it is not clear as to whether the well or the <br />septic tank will be used in conjunction with the barn. All building code and engineering <br />requirements are included in the conditions of approval. <br /> <br />In response to an inquiry by Chair Barker, Mr. Swift clarified that condition #2 builds in <br />requirements for approval should additional agricultural uses of this site be requested. He clarified <br />that no subdivision of the site shall be allowed without an application and approval for a development <br />plan. <br /> <br />Commissioner Cooper inquired as to the General Plan zoning designations for this area. Mr. Swift <br />advised that the General Plan includes numerous potential uses for this area. The specific plan will <br />determine the intensity and location of these uses within the entire area. <br /> <br />In response to a question from Commissioner Lutz, Mr. Swift gave an overview of the size and uses <br />of the neighboring parcels. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mike Madden, 2776 Hartley Gate Court, represented the applicant, Silver Bear, Ltd. He clarified <br />that he is not the owner of the property and that the purchase of the property is contingent on being <br />able to build a barn on the site. <br /> <br />Leonard R. Thibault, 30 Castlewood Drive, advised that he owns property to the east of the proposed <br />site. He asked if the intent of the approval is to just construct a barn on the site. He was advised <br />that this was the case. He also asked if the barn will be constructed on a concrete slab.
