<br />Mr. Swift presented the staff report recommending approval of Case UP-97-08/Z-97-27, subject to <br />the conditions of the staff report. Mr. Swift noted that staff is satisfied with the applicant's proposal <br />and feels that the use will be a good neighbor to surrounding properties. <br /> <br />Commissioner Lutz asked what will happen after five years, if a permanent building is not built to <br />replace the modular. Mr. Swift advised that it will be removed or the applicant may request an <br />extension to keep the modular in place. <br /> <br />In response to Commissioner Cooper's question as to whether maintenance of vehicles is anticipated, <br />Mr. Swift stated that this would not take place on the site. <br /> <br />Chair Barker asked if the five-year condition was placed on the City's modulars. Mr. Swift <br />responded that he did not believe it was. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mike St. John, 383 Christina Court, the project manager for the property owner, advised that the <br />area in which the site is located is in transition. He noted that the entire area is improving and he <br />sees no problem with replacing the modular with a permanent building within five years. He advised <br />that fueling of vehicles is currently allowed and that this will continue. Commissioner Kumaran <br />asked Mr. St. John if he could give some idea as to when the modular will be replaced. Mr. St. <br />John advised that he did not wish to discuss this issue in the public forum, as negotiations are <br />underway. <br /> <br />Commissioner Kumaran asked if the Planning Commission has any restrictions as to the aesthetic <br />appcal of the modular building. Mr. Swift advised that the Planning Commission is considering the <br />application for the design review in conjunction with the use permit this evening. He noted that the <br />modular is an improvement over surrounding buildings. He confirmed that the City's architectural <br />consultant had not reviewed the project. <br /> <br />Mr. St. John reported that the request to allow the modular to be in place for five years is based on <br />fact that A vis had five years remaining on their lease. He noted that the modular will be set at <br />ground level with sidewalks and stucco exterior, and will look like a permanent facility. <br /> <br />Commissioner Wright stated that he is satisfied with the design, especially since it will be at grade <br />level. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />A motion was made by Commissioner Lutz, seconded by Commissioner Wright, making the <br />conditional use permit findings and approving Case UP-97 -08/Z-97 -27, subject to the conditions <br />listed in Exhibit"B." <br /> <br />Planning Commission Minutes <br /> <br />Page 4 <br /> <br />June 25, 1997 <br />
