<br />5. MATTERS CONTINUED FOR DECISION <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />a. UP-97-35. Ed Kohl <br />Application for a conditional use permit for an attached second unit within a single-family <br />residence located at 1310 Galanti Court. Zoning for the property is PUD (Planned Unit <br />Development) - A/OS/LDR (Agriculture/Open Space/Low Density Residential) District. <br /> <br />Mr. Swift presented the staff report recommending approval of Case UP-97-35, subject to the <br />conditions of the staff report. He noted that the application is for a second unit in the applicant's <br />residence located in Ruby Hill. The original plan for the residence included a "maid's quarters" with <br />a separate exterior entrance; however, a kitchen was not included in the original plan. The applicant <br />is now asking for a conditional use permit to allow that space to be characterized as an official <br />second unit. Mr. Swift advised that the conditions of approval includes the requirement that one of <br />the units be owner-occupied and limits the number of people who may occupy the second unit. <br /> <br />Chair Barker asked if a condition requiring that the resident owner be signatory to the lease/rental <br />of the second unit is included. Mr. Swift stated that Condition #3 could be modified to include this <br />requirement. <br /> <br />In response to Chair Barker's question, Mr. Swift advised that proposals of this type go before Ruby <br />Hill's Architectural Review Committee. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />No one spoke regarding this application. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />In response to Commissioner Wright's inquiry, Mr. Swift stated that this application has been <br />reviewed and approved by the Ruby Hill review panel, including the requirement for two separate <br />addresses and two mailboxes. <br /> <br />A motion was made by Commissioner Wright, seconded by Commissioner Cooper, making the <br />conditional use permit findings and approving Case UP-97-35, subject to the conditions listed <br />in Exhibit"B," with the following modifications: <br /> <br />Amend Condition #3 requiring that the resident owner shall be signatory to any lease or <br />rental. <br /> <br />Planmng Commission Minutes <br /> <br />Page 2 <br /> <br />June 25, 1997 <br />
