<br />Mr. Iserson advised that no comments have been received from adjacent neighbors of the project. <br /> <br />~ <br /> <br />In response to a question from Commissioner Kumaran as to why this project is unique and requires <br />Planning Commission approval, Mr. Iserson advised that because it is new development in the <br />Downtown area, the Code requires Planning Commission approval. <br /> <br />Commissioner Cooper inquired as to the setbacks of the adjacent neighboring buildings at 261 Spring <br />Street. Mr. Iserson indicated that the building setback is approximately five feet. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Gary Pebelier, 241 Spring Street, represented the application. He stated that he has reviewed the <br />staff report and agrees with the conditions of approval. <br /> <br />Commissioner Lutz asked the applicant about his proposed construction schedule. Mr. Pebelier <br />responded that he is almost done with the duplex, and upon its completion he will apply for <br />refinancing and begin construction of the two additional units. He anticipates this to be in <br />approximately five to six months. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Lutz commented that he is pleased to see the opportunity for additional residential <br />dwellings in the Downtown area. <br /> <br />Commissioner Cooper commented that he feels there is a need for residential use Downtown. <br /> <br />A motion was made by Commissioner Cooper, seconded by Commissioner Lutz, approving Case <br />Z-97-79, subject to the conditions listed in Exhibit "B." <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Cooper, Kumaran, Lutz, Wright and Chair Barker <br />None <br />None <br />None <br /> <br />Resolution No. PC 97-47 was entered approving Case UP-97-23, as motioned. <br /> <br />e. PUD-81-30-38M/PUD-85-08-15M. Hacienda Owners Association <br />Application for a major PUD modification to modify the conditions of approval to allow the <br />elimination of the air, noise, and water quality monitoring requirements for the Hacienda <br />Business Park. Zoning for the property is PUD (planned Unit Development) - I-C/O <br />(Industrial-Commercial-Office) District. The Planning Commission will also consider the <br />Negative Declaration prepared for the project. <br /> <br />Mr. Iserson presented the staff report recommending approval of Case PUD-S1-30-3SM and <br />PUD-S5-S-15M, subject to the conditions of the staff report.
