<br />Terry Yee, 30 W. Neal Street, #110, represented the application. Mr. Yee advised that his intent <br />would be to have soft, background music (such as a piano or harp) and not amplified, loud music. <br />He stated that he was in agreement with the conditions of the staff report. He also advised that he <br />was not interested in offering hard liquor and that it is more expensive and more difficult to obtain <br />a liquor license for hard liquor. <br /> <br />Commissioner Lutz asked the applicant about his plans for signage. Mr. Yee responded that he <br />would like to install the optimum amount of signage. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />A motion was made by Commissioner Kumaran, seconded by Commissioner Wright, making <br />the required conditional use permit findings and approving Case UP-97-24, subject to the <br />conditions listed in Exhibit "B," with the following modification: <br /> <br />Amend Condition #7 to read as follows: <br /> <br />No amplified music shall be allowed on the outdoor deck areas after 8:00 p.m. on <br />weekdays and 9:00 p.m. on Friday and Saturday nights. Z-97-79. Gary Pebelier <br />Application for design review approval to construct a two-unit dwelling to be located behind an <br />existing two-unit dwelling located at 249 Spring Street. Zoning for the property is C-C (Central <br />Commercial) District, Core Area Overlay, Downtown Revitalization District. <br /> <br />Mr. Iserson presented the staff report recommending approval of Case Z-97 - 79, subject to the <br />conditions of the staff report. He provided the history of this application, noting that a previous <br />approval was granted in 1992. The first phase of project is near completion; however, the approval <br />for the second phase has lapsed. The applicant is reapplying for approval of the second phase. He <br />advised that the project is basically the same as that which was approved in 1992. <br /> <br />Mr. Iserson indicated that the design of the project maintains the old town look of the area and the <br />project meets the goals of the Downtown Specific Plan, the standards of the Downtown design <br />guidelines, and the Core Overlay District.
