<br />6. PUBLIC HEARINGS <br /> <br />~ <br /> <br />a. UP-97-22. Rickie Slominski. dba One Park Avenne <br />Application for a conditional use permit to conduct massage therapy within an existing beauty <br />salon located at 3120 Santa Rita Road, Suite F. Zoning for the property is PUD (Planned Unit <br />Development) - C-O (Commercial-Office) District. <br /> <br />Mr. Iserson presented the staff report recommending approval of Case UP-97-22, subject to the <br />conditions of the staff report, with a modification to Condition #7 adding the requirement that the <br />applicant would obtain all Fire Department approvals prior to operation. He also noted that there <br />is a discrepancy between the proposed hours of operation stated in the staff report and those stated <br />in the conditions of approval. (During the public hearing, the applicant confirmed that the requested <br />hours of operation are Thursday and Saturday.) <br /> <br />Mr. Iserson advised that the massage therapy services would be operated within an existing beauty <br />salon and that some of the clients are currently clients of the salon, therefore, resulting in less impact <br />on additional parking. <br /> <br />Mr. Iserson also referred to the letter received by the Planning Department on May 23, 1997, from <br />Eric and Beverly Strickland, regarding concerns related to the proposed massage therapy business. <br />He advised that the information provided in the staff report addressed the concerns in the letter, and <br />that Mr. and Mrs. Strickland were given a copy of the staff report and advised that they could attend <br />this evening's Planning Commission meeting if they still had concerns regarding the proposed use. <br /> <br />In response to Commissioner Wright's question regarding the reason for Fire Department approval, <br />Mr. Iserson advised that the Fire Department's inspection is to assure that all Fire Codes are met. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Rickie Slominski, 3120 Santa Rita Road, Suite F, represented the application. She stated that she <br />had read the staff report and is in agreement with the conditions. In response to her question as to <br />whether she would have to come back to the Planning Commission if an additional therapist is hired, <br />Mr. Iserson advised that the request would have to be made to the Planning Department and a <br />determination would be made as to whether there is a need to hold a public hearing before the <br />Planning Commission or if the approval could be granted by staff. Ms. Slominski stated that her <br />objective is to add a second massage therapist. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright noted by the time the applicant comes back with a request for an additional <br />therapist a Code revision allowing conditional use permits for massage therapists to be approved at <br />the staff level, may be approved. <br /> <br />A motion was made by Commissioner Cooper, seconded by Commissioner Lutz, making the <br />required conditional use permit findings and approving Case UP-97 -22, subject to the conditions <br />listed in Exhibit "B," with the following modifications: <br /> <br />Planning Commission Minutes <br /> <br />Page 2 <br /> <br />May 28, 1997 <br />
