<br />Patrick Currin, 8272 Sassafras Court, represented his application. He provided the Commission with <br />pictures of the Golden Eagle Farms development for their clarification. <br /> <br />Regarding the caretaker issue, it is their feeling that the residential use of the adobe is a vested <br />nonconforming use and that it has been used as a residential use ever since the first PUD approval. <br />Mr. Currin feels the residents have a problem with the adobe being used as a personal residence and <br />as a commercial venture. <br /> <br />r-- <br /> <br />Mr. Currin feels the staff report is very balanced. The occupancy level for the business use will be <br />less than 100, usually 50-100. The occupancy level for weekend activities is on the low end, but <br />it is acceptable. <br /> <br />Mr. Currin stated the closest executive home is 75 yards north of the adobe. The applicants have <br />worked closely with the two closest residents, eliminating the rear service area and constructing a <br />soundwall. Also, Mr. Currin stated that on average, the average home on the west side is 1000 <br />yards away. <br /> <br />Mr. Currin spoke on the issue of disclosure to the Golden Eagle Farms residents. It has been part <br />of the public record that this was to be a special events center. However, Mr. Currin does not know <br />what was said to the home purchasers. He feels the community at large will benefit from this events <br />center; with the numerous conditions put on this use, there can be a harmonious relationship. <br /> <br />In response to Commissioner Cooper, Mr. Currin advised he is currently living in this adobe, which <br />is not in conformance with the use permit. Mr. Currin advised that they have had problems with <br />.r trespassers, etc. and that is the reason for him living in the adobe. <br /> <br />Chair Barker clarified with staff that these issues will probably go on to the City Council. <br /> <br />Ramsey Araj, 2002 Valley Oak, is one of the adjacent properties to the adobe. He noted that the <br />adobe has been a single family residence for 150 years. The general concept for the area was to be <br />a residential community; the intent was to provide a very peaceful, quiet community in a semi-rural <br />setting. With Currin's right to have fair use of his property, Mr. Araj struggled with the ethics; Mr. <br />Currin has the right to enjoy his property as Mr. Araj wishes to enjoy his own. Originally, Mr. <br />Currin was hoping to keep the adobe as a residence and subdivide the property. Mr. Araj stated he <br />was told by staff that the Currins were approved to increase the density of the development on the <br />east side of the property and add 12 lots on the same amount of acreage, and the Currins would <br />provide the community with this service. Staff could not comment on these statements. The general <br />interests of the community and the surrounding neighbors should be attended to first and foremost. <br /> <br />This adobe center was modeled after the Century House. However, the adobe has access by a two- <br />lane rural road in a quiet rural neighborhood as compared to the Century House being on a main <br />thoroughfare in the center of town. This is an unfair comparison. <br /> <br />Mr. Araj spoke about the heavy use of the special events center for several hours every day and <br />evening, even on holidays on Easter and Thanksgiving.
