Further, Mr. Araj does not feel it is logical that this single-family home, consisting of three rooms
on the first floor, be used for 120 persons.

~

The increased traffic is a hazard and should be considered. The pool and tennis areas are used by
people on both sides of Foothill and the increased traffic will be a safety hazard to the children.

Mr. Araj noted that his property is at the entry of the Golden Eagle development. For whatever
reason, he feels the people gaining access to the staging area have caused property damage to his
lawn by driving over it, littering, etc.

The speaker is opposed to the special events use of the adobe, however, if it is approved, please
consider the following:

There is no reason to wait six months before making landscape plans. Urge occupancy maximum
of 80-100 not l00-120--this should also include staff personnel. It is not enforceable for the
caretaker to use the downstairs kitchen; the second floor should be made into a self-contained
apartment. Mr. Araj asked that alcohol be allowed only on weekends and then only beer and wine.
With a commercial venture in a residential neighborhood, it is inappropriate to have late evening
hours. Music until 9 pm is unacceptable to a residential neighborhood with children. Normal
business hours are appropriate for this business venture. Prohibit activities one day per week,
preferably Sundays. Indoor-only events on weekdays. Music was to be acoustical string
instruments, i.e., no vocals and no amplification. Feels the entire soundwall should be a solid wall.
The Homeowners Association should be allowed some input on the design of the Adobe sign. Does
not want any heritage trees to be removed. Require the applicant or developer to post a bond to
repair any damages caused.

commissioner Lutz stated he is concerned about the damage Dr. Araj suffers to his property from
people using the adobe. Dr. Araj believes the people may have trespassed; further, the general
public has access to Golden Eagle Way to the upper staging area. Commissioner Lutz does not know
how this damage could occur with the security personnel at the gate; however, Dr. Araj was adamant
that he has suffered physical damage to his property.

Tom DeWitt [no address given] is opposed to the use of the adobe as a special events center. He
does not want his "dream home" to be ruined by the proposed activities at the adobe. If approved,
he will stop this project. Mr. DeWitt feels he was lied to and conned regarding the disclosure about
the future use of the adobe. He does not want people drinking and partying next to his residence.

Commissioner Wright asked Mr. DeWitt what representations were made to him at the time of his
lot purchase. Mr. DeWitt stated they were told it would either remain an historical land site or
become a museum. Several people were told it would be a single family home.

Mr. DeWitt is opposed to having so many people adjacent to his residence; he will lose his privacy.
He feels that if it had been properly represented, no one would have bought the surrounding lots.
There has already been an unfortUnate experience with a wedding.

Planning Commission Minutes

Page 7

May 14, 1997

__..__________~____u__..__..._...
