Susan Garcia/Blue Al!ave Club <br />Application for a conditional use permit to serve alcohol after 10:00 p.m., conduct tasting <br />classes, and feature live music at an existing restaurant located at 625 Main Street. Zoning for <br />the property is C-C (Central Commercial) District. <br /> <br />Mr. Iserson presented the staff report for a conditional use permit to serve alcohol after 10:00 p.m., <br />conduct tasting classes, and feature live music at the Blue Agave Club located at 625 Main Street <br />(former Hacienda Del Sol restaurant). The property is zoned Central Commercial (C-C), Downtown <br />Revitalization, Core Area Overlay District. <br /> <br />The Code specifies that any facility serving alcohol after 10 pm is automatically classified as a bar, <br />even though the main purpose is a restaurant. A conditional use permit is required for the bar use. <br /> <br />This operation is occupying the former Hacienda Del Sol restaurant building on Main Street. There <br />are existing outdoor dining areas which are fenced and conform to the outdoor dining guidelines. <br />The applicants wish to continue this use and serve food and alcoholic beverages both indoors and <br />outdoors. The hours of operation are proposed to be 11 am to 10 pm, Monday to Thursday, 11 am <br />to 2 am on Friday, 9 am to 2 am on Saturday, and 9 am to 10 pm on Sunday. The applicants are <br />also requesting an additional hour at night during daylight saving time. <br /> <br />Twelve persons would compose the usual permanent staff. The live music would consist of strolling, <br />non-amplified guitarists up to 11 pm. The applicants would also like to have tequila tasting classes <br />in the lounge area. <br /> <br />Staff feels this restaurant and bar operation would be complementary to other uses in the downtown; <br />further, staff feels the restaurant and bar will not create problems as have other bars in the <br />downtown area. The Police Department did not express any concern with this application, and staff <br />has not received any comments/complaints from surrounding businesses. <br /> <br />Staff does not feel that noise would be a problem; however, if it proves to be so, soundproofing can <br />be done at a later date. The Code does not require more parking than is already available. There <br />were no parking problems with the previous restaurant use. The site is adjacent to the City's parking <br />lot. <br /> <br />Staff is proposing the existing trash dumpster be completely enclosed. Because it is an existing <br />situation, they will not require the trash enclosure to be hooked up to the sanitary sewer system. The <br />design of the trash enclosure could either match the existing fence or the design of the adjacent City- <br />built trash enclosure which will be constructed in the near future. <br /> <br />Staff believes the findings for the use permit can be made and recommends approval of Case UP-97- <br />9 subject to the conditions of approval listed in the staff report. <br /> <br />Commissioner Cooper inquired whether the acoustic guitar music was required by an ordinance.
