5) Continued enforcement. ~he City Engineer shall investigate <br />any purported violation of performance standards. If there is reasonable <br />causes he shall notify the Commission of any probable violation. ~he <br />Ccr~ssion shall investigate the alleged violation and if after public <br />hearing on due notices the Co~m~_ssion finds that a violation occurred or <br />exists, a copy of said findings shall be forwarded to the City Council. <br /> <br /> 19.804 Sl~ plan ~nd Arc~it~t, tP~l Approval The purpose of the <br />site ~a ~'~c~'~'~u~'f~pproval is "~:~evant the impairment <br />or depreciation of land values and development by the erection of struck, <br />tures or additions or alterations thereto pithout proper atten~ion to siting, <br />or of unsightly, undesirable or obnoxious appearance. <br /> <br /> Applications shall be filed ~ith the folioping: <br /> <br /> 1) Naps and dravings in duplicate to indicate the siting of all <br />structures on subject property and on adjoining property to show that <br />light and air are preservedr such as not to be detrimental to the orderly <br />and harmonious development of the City or to impair the desirability o~ <br />investment or occupation in the adjoining areas. Landscaping and/or <br />fencing of yards and setback areas, use of landscaping and/or yells or <br />fences for screening purposes and desinn of ingress or egress so as not <br />to interfere ~ith normal traffic flow on abutting streets~ and off-street <br />parking and loading facilities. Architectural drawings or sketches in dup- <br />licate of the exterior elevations and/or perspective draping, of the <br />building or structures under consideration. <br /> <br /> 2) The Planning Conunission shall determine from data submitted <br />~hether the proposed use pill meet the requirements of this ordinance and <br />shall approve the application upon making a positive findinS. The <br />application may be disapprovedr may be approved as submitted, or may be <br />approved subject to conditions, specified changes or additions. <br /> <br /> 3) The Commission shall have the functions duty and po~er to approve <br />or disapproves or to approve subject to compliance with such modifications <br />or conditions as the said Commission may deem necessary to carry out the <br />purpose of theae regulations, the external design of all proposed hey <br />buildings or structures for ~hich site plan and architectural approval is <br />required. <br /> <br /> 4) In carryin~ out the purposes of this Section pith respect to <br />the external design of buildings, the Commission shall keep in =ind the <br />following principles: <br /> <br /> a. It is not a purpose of this Section that control of architec- <br /> tural character should be so rigidly enforced that individual <br /> initiative is stifled in the design of any particular build- <br /> ing or substantial additional expense incurred; rather, it is <br /> intent of this Section that any control exercised be the <br /> minimum necessary to achieve the overall objective of this <br /> Section. <br /> <br /> <br />
