<br />Wireless Telecommunications Facilities Policy (City of Pleasanton) page 4 / 37 <br /> <br />(f) “City Council” means the City Council of the City of Pleasanton, California. <br /> <br />(g) “collocation” means the same as defined by the FCC in 47 C.F.R. § 1.6002(g). <br /> <br />(h) “CPUC” means the California Public Utilities Commission established in the <br />California Constitution, Article XII, § 5, or its duly appointed successor agency. <br /> <br />(i) “Department” means the City of Pleasanton Community and Economic <br />Development Department. <br /> <br />(j) “Director” means the City of Pleasanton Community and Economic Development <br />Department Director or their designee. <br /> <br />(k) “eligible facilities request” means the same as defined in 47 U.S.C. § 1455(a)(2), <br />and as interpreted by the FCC in 47 C.F.R. § 1.6100(b)(3). <br /> <br />(l) “FCC” means the “Federal Communications Commission”, as constituted by the <br />Communications Act of 1934, Pub. L: 73-416, 48 Stat. 1064, codified as 47 U.S.C. <br />§§ 151 et seq. or its duly appointed successor agency. <br /> <br />(m) “Fire Safety Authority” means the Livermore-Pleasanton Fire Department or their <br />designee. <br /> <br />(n) “historic resource” means any prehistoric or historic district, neighborhood, site, <br />building, structure or object included in, or eligible for inclusion in the National <br />Register of Historic Places or the California Register of Historical Resources, or <br />identified in the City of Pleasanton General Plan or the Downtown Specific Plan. <br />The term includes artifacts, records and remains related to or located within such <br />properties. The term also includes properties with traditional religious and/or <br />cultural importance to any Native American tribe. <br /> <br />(o) “ministerial permit” means any City-issued non-discretionary permit required to <br />commence or complete any construction or other activity subject to the City’s <br />jurisdiction. Ministerial permits may include, without limitation, any building <br />permit, construction permit, electrical permit, excavation permit, traffic control <br />permit, encroachment permit and/or any similar over-the-counter approval issued <br />by the City’s departments. <br /> <br />(p) “Municipal Code” means the City of Pleasanton Municipal Code. <br /> <br />(q) “OTARD” means any “over-the-air reception device” subject to 47 C.F.R. §§ <br />1.4000 et seq., which generally includes satellite television dishes and certain fixed <br />wireless antennas not greater than one meter in diameter. <br /> <br />Docusign Envelope ID: 51CE5BDE-55F1-4B3D-8865-17E5814CF0C5
