<br />Wireless Telecommunications Facilities Policy (City of Pleasanton) page 3 / 37 <br />equivalent personal wireless services; (4) deny any request for authorization to <br />place, construct or modify personal wireless service facilities on the basis of <br />environmental effects of radio frequency emissions to the extent that such wireless <br />facilities comply with the FCC’s regulations concerning such emissions; (5) prohibit <br />any collocation or modification that the City may not deny under federal or <br />California state law; (6) impose any unreasonable, discriminatory or <br />anticompetitive fees that exceed the reasonable cost to provide the services for <br />which the fee is charged; or (7) otherwise authorize the City to violate any <br />applicable federal or California state law. <br /> <br />Section 3. DEFINITIONS <br /> <br />The abbreviation, phrases, terms and words used in this policy will have the following <br />meanings assigned to them unless context indicates otherwise. Undefined phrases, terms <br />or words in this section will have the meanings assigned to them in 1 U.S.C. § 1, as may <br />be amended or superseded, and, if not defined therein, will have their ordinary meanings. <br /> <br />The definitions in this policy shall control over conflicting definitions for the same or similar <br />abbreviations, phrases, terms or words as may be defined in the Municipal Code. <br />However, if any definition assigned to any phrase, term or word in this chapter conflicts <br />with any federal or state-mandated definition, the federal or state-mandated definition will <br />control. All references to codified statutes, regulations or other rules shall be deemed to <br />refer to such statutes, regulations or other rules as they may be amended or superseded. <br /> <br />(a) “amateur station” means the same as defined by the FCC in 47 C.F.R. § 97.3, <br />which defines the term as “a station in an amateur radio service consisting of the <br />apparatus necessary for carrying on radiocommunications.” This term includes <br />amateur radio antennas and related facilities used for amateur radio services. <br /> <br />(b) “appellate authority” means the City official or appointed/elected body <br />responsible for review of approval authority decisions and vested with authority to <br />hear and decide appeals. For appeals from either the Zoning Administrator or the <br />Planning Commission, the appellate authority shall be the City Council. <br /> <br />(c) “approval authority” means the City official or appointed/elected body <br />responsible for application review and vested with authority to approve or deny <br />such applications. For Wireless Facility Permits, the approval authority shall be the <br />Zoning Administrator, unless referred by the Zoning Administrator to the Planning <br />Commission. <br /> <br />(d) “architecturally integrated” means stealth concealment that mimics the existing <br />architecture, design, materials and finishes of the underlying structure such that <br />the wireless facility appears to be something other than a wireless facility and <br />part of the original structure’s design. <br /> <br />(e) “City” means the City of Pleasanton, California. <br />Docusign Envelope ID: 51CE5BDE-55F1-4B3D-8865-17E5814CF0C5
