<br />Resolution No. PC-96-24 <br />Page 2 <br /> <br />There will be little or no impact on the existing sewer and utility system from the <br />proposed second unit. <br /> <br />C. The proposed conditional use will comply with each of the applicable provisions <br />of this chapter. <br /> <br />As proposed and conditioned, the use complies with all applicable regulations of <br />the zoning district in which the second unit is located. Granting a conditional use <br />permit to Patricia McInerney is consistent with the City's ability to regulate <br />zoning as listed in the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />o WHEREAS, the Planning Commission determined that the proposed secondary unit is in <br />compliance with State law and that the required findings for a conditional use <br />permit can be met. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-94-24, the application of Patricia McInerney and Mary Ellen <br />Roche Arakorpi for a conditional use permit to establish a second unit within an <br />existing detached structure located at 1133 Arak Court, subject to the conditions <br />shown in Exhibit "B," attached hereto and made part ofthis case by reference. <br /> <br />Section 2 <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 24TH DAY OF APRIL 1996 BY THE FOLLOWING VOTE: <br />A YES: Commissioners Hovingh, McGuirk, Wright, and Chairman Lutz <br />NOES: Commissioner Barker <br />ABSENT: None <br />ABSTAIN: None <br /> <br />A~, <br />CJ1 AdA~ <br /> <br />Pegg d <br />City Clerk <br /> <br />l~r4 <br /> <br />Chairperson <br /> <br />APPROVED AS TO FORM: <br /> <br />C{;Y/\/\~/1 B~_ <br /> <br />Dennis Beougher <br />Assistant City Attorney <br />
