<br />Resolution No. PC-96-24 <br />Page 3 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-94-24 <br />(April 24, 1996) <br /> <br />1. That the use and all improvements shall substantially conform to Exhibit "A" - the site <br />and floor plan, dated "Received" May 6, and June 1, 1994, on file with the Planning <br />Department, except as modified by the following conditions. <br /> <br />2. The applicant shall arrange with the City's Building Department an inspection of the <br />second unit immediately after the existing tenants have vacated the property. The <br />applicant shall obtain all the necessary City permits to legalize the second unit. The <br />applicant shall secure these permits within thirty (30) days from the date of use permit <br />approval or from the date the existing tenants have vacated the property, whichever is <br />later. <br /> <br />3. Only one residential unit on the subject property may be rented. The other unit shall be <br />owner-occupied. With regards to the secondary unit, the unit shall be occupied by no <br />more than two adults, although there shall be no limit on the number of children. The <br />applicant shall prepare a deed restriction to this effect and shall submit it to the City <br />Attorney for review and approval prior to recordation. The recordation shall be <br />accomplished within thirty (30) days of conditional use permit approval for the second <br />unit. <br /> <br />4. In no case shall the secondary unit be sold, subdivided, or held under different legal <br />ownership from the primary residence. A deed restriction shall be recorded to this effect. <br />The applicant shall prepare the deed restriction and shall submit it to the City Attorney <br />for review and approval prior to recordation. The recordation shall be accomplished <br />within thirty (30) days of conditional use permit approval for the second unit. <br /> <br />5. If the operation of this use results in conflicts pertaining to parking, traffic, noise, or other <br />impacts, at the discretion of the Planning Director, this use permit may be submitted to <br />the Planning Commission for subsequent review at a public hearing. If necessary, the <br />Commission may modify or add conditions of approval to mitigate such impacts, or may <br />revoke said use permit. <br /> <br />6. The applicant shall maintain the posted address for the second unit on the front of the <br />property so as to be plainly visible from Arak Court during both daylight and night time <br />hours. <br /> <br />7. Within thirty (30) days of conditional use permit approval, the applicant shall pay all <br />applicable Zone 7 and City connection fees and water meter cost for any water meters. In <br />addition, the applicant shall pay any applicable Dublin San Ramon Sewer District <br />(DSRSD) sewer permit fees. <br />
