3 iii) Unforeseen Closure. City reserves the right to cancel Seahawks scheduled use and close all or a portion of the DBAC at any time to conduct emergency mechanical or maintenance repairs. iv) Other Uses. Other uses not defined at this time. v) City Rights. The parties acknowledge that for special uses City has the absolute right to use the 50 meter or 25 meter pool, even if during Seahawks scheduled use times. 2) Rules for Use. Seahawks shall abide by all City rules as set forth in the Pleasanton Municipal Code, City Council resolutions, as well as the DBAC Pool Rules as set forth in Exhibit C, as may be amended in the discretion of City. 3) Term. This Agreement begins on September 1, 2025, and expires on August 31, 2026. a) Agreement Renewal. City and Seahawks may renew by mutual agreement between the parties. Each party retains the right to not renew the Agreement. 4) Fees. The fees for September 1, 2025 through August 31, 2026, are set forth in Exhibit A. a) Seahawks shall pay the rate of the staff fee listed in Exhibit A for times when the City must schedule City Facility Monitors solely for the Pleasanton Seahawks facility use. The scheduled times are more specifically set forth in Exhibit B. b) For all swim meets and other events, Seahawks shall pay the City facility rental and staff fees listed in Exhibit A. c) Each August, Seahawks shall be provided with the new Team Rental Rates (Exhibit A) for the following year (September 1 through August 31). d) Invoicing and payment. City shall invoice Seahawks monthly, and Seahawks shall pay City within 30 days. The City may deny Seahawks use of the DBAC for any nonpayment. i) Swim meets and pre-approved special events shall be invoiced separately by City based on rates in Exhibit A, as may be annually amended.
