2
advance. Seahawks shall discuss with City potential open dates for swim meets
prior to any bid submittal. City shall make a good faith effort to provide pool and
park availability, subject to other agreements and programs that may already be in
place for the pool and/or adjacent park facilities.

i) During swim meets, City shall use its best efforts to provide signage on-site,
on City's website, and work with the City’s Community and Public Relations
Coordinator to appropriately notify parties that may be impacted by any
swim meet. City may use its own staff as parking lot attendants, with
assistance from Seahawks volunteers.

ii) All related City costs (including, but not limited to, staffing, additional
custodial services, and radio rentals) arising from a swim meet shall be
invoiced to Seahawks following the meet and Seahawks shall pay City for
all costs within 30 days.

iii) City shall permit food vending during Seahawks swim meets, provided the
vendors have all necessary business licenses and health permits. City shall
allow Seahawks to use vendors of its choice, while encouraging the use of
Pleasanton vendors whenever feasible. All vendors shall be subject to the
City's review and concurrence for consistency with recreational and facility
use. Seahawks shall ensure that such vendors comply with the City of
Pleasanton's business license requirements and Alameda County
Department of Environmental Health’s Mobile Food Facilities (MFF)
requirements.

iv) Dumpsters through Pleasanton Garbage Service shall be coordinated
directly by Seahawks.

v) An individual Conditions of Use Agreement may be required by the City for
each Seahawks swim meet and other unique event.

d) Special Use. City or Seahawks may request, on a month-to-month basis and, when
possible, at least one week advance notice to the other party, special uses of the
reserved pool space, including the following:

i) Additional Lanes. City may require additional lane space from time to time
for special aquatics classes, such as Water Safety Instructor (WSI) or
Lifeguard Training and City shall endeavor to provide adequate advance
notice to the Seahawks. Seahawks agree to reasonably accommodate such
requests.

ii) Annual Maintenance. City may close the DBAC for maintenance at least l
week each year.
Docusign Envelope ID: 7456A597-CFB8-4FFB-9D8C-4597DADAEB67Docusign Envelope ID: 7D0331A2-6783-4F05-B5C7-C551B8318F3C
