Page 3 of 4 <br />references the Public Contract Code itself where those dollar amounts are listed, alleviating <br />the need to make amendments to the Municipal Code whenever this section of the Public <br />Contract Code is amended. <br /> <br />In §7.20.050 Hearing – Schedule – Notice, current language requires the City Clerk to <br />schedule a hearing to a vicious dog hearing no longer than 10 days from receipt of a <br />certification that such hearing is necessary. The proposed amendment clarifies that the “days” <br />referenced in this section are business days. The service of notice is also updated to allow <br />service by email, mail, and personal service. The hearing location has be updated to allow for <br />virtual hearings to accommodate scheduling timelines and to allow greater flexibility for both <br />city staff and residents to hold a hearing. <br /> <br />Chapter 9.14 Stormwater Management and Discharge Control was a model storm water <br />ordinance recommended by the Alameda County Clean Water Authority and was adopted on <br />June 4, 2024 (Ord. 2281). The adoption of the model ordinance, however, did not include <br />Watercourse protection provisions, which were previously codified in the Municipal Code as <br />Chapter §9.14.090. This amendment serves include previously codified §9.14.090 back into <br />Chapter 9.14 as §9.14.095. Minor formatting changes to §9.14.100. <br /> <br />In Chapter 13.08 Library and Recreation. Amend §13.08.020 to update the definition of <br />"Director" to reflect actual title, as well as amend the definition of "Director" to allow for the <br />designation of the position. In §13.08.110 Vehicles, amends current language to utilize the <br />defined title of "Director." In §13.08.150 Motor driven cycles and model vehicles and planes, <br />current language prohibits the operation of any airborne, waterborne, or landborne model <br />planes, vessels or vehicles without the written permission of the director. Because only <br />“planes” are specifically prohibited, a loophole in the prohibition existed wherein unmanned <br />drones and model rotorcraft (helicopters) were not prohibited under the current language. The <br />Federal Aviation Agency defines “aircraft” as any devices that is used or intended to be used <br />for flight in the air, including planes. This amendment would prohibit the operation of motorized <br />aircraft from park and recreation facilities without distinguishing planes from unmanned drones <br />or other types of aircraft, such as model rotorcraft (helicopters) and gliders. <br /> <br />In Chapter 14.04 Regulation of Water System and Water Services Fees, add to §14.04.010 the <br />definition of “non-functional turf.” In §14.04.060(G), additional language is added to prohibit the <br />use of potable water on “non-functional turf” to comply with state law (AB 1572 of 2024). <br /> <br />In Chapter 18.36 RM Multi-Family Residential Districts, amends the following sections of the <br />Municipal Code to comply with state law (AB 2334 of 2022): §18.36.060, §18.44.080, and <br />§18.84.030. These are technical changes to modify language “referencing site area unit” to <br />“dwelling units per acre” so that the Municipal code reflects a non-negotiable density standard <br />instead of a development standard that may be waived by the State Density Bonus Law (as <br />amended by AB 2334 of 2022). To remedy currently existing omissions, amendments propose <br />to include the R-1 District in a list of zoning districts that allow residential uses where the code <br />identifies how to round the numerical value of unit calculations, such as the method that is <br />consistent with the other zoning districts. No additional density is being conferred with these <br />modifications as the proposed text amendment reflect a mathematical conversion. <br /> <br />In Chapter 18.68 PUD Planned Urban Development District, remove from §18.68.070 <br />identifying the City as a third party beneficiary to conditions, covenants, and restrictions placed <br />Page 8 of 864
