Amend §14.04.060(G) <br />to add additional restrictions prohibiting use of potable water on “non-functional turf” to comply <br />with state law (ABl 1572 of 2024). <br /> <br />Chapter 18.36 RM Multi-Family Residential Districts – Amend §18.36.060, §18.44.080, and <br />§18.84.030 to comply with state law (AB 2334 of 2022). <br /> <br />Chapter 18.86 PUD Planned Urban Development District – amend §18.68.070 to remove <br />section identifying City as a third-party beneficiary. <br /> <br />There is a resolution to amend the Purchasing Procedures and Manual in Section 3.6 Direct <br />Payment Claim Form to remove a provision that required City Manager approval for purchases <br />more than $10,000. <br /> <br />RECOMMENDATION <br />Introduce an omnibus ordinance to amend the Municipal Code in Chapters 1.04 General <br />Provisions, 2.34 Library Commission, 3.32 Alternative Bidding Procedures under the Uniform <br />Public Construction Cost Accounting Act, 7.20 Vicious Dogs, 9.14 Stormwater Management <br />and Discharge Control, 13.08 Parks and Recreation Facilities, 14.04 Regulation of Water <br />System, 18.36 RM Multi-Family Residential Districts, and18.68 PUD Planned Urban <br />Development District, and waive first reading; and resolution to update the City’s Purchasing <br />Policy. <br /> <br />BACKGROUND <br />The municipal code must be amended regularly to reflect new or updated California laws as <br />well as actual City practices. These routine updates are combined into a single omnibus <br />ordinance. One resolution is also proposed to amend the Purchasing Procedures and Manual. <br /> <br />DISCUSSION <br />Each of the proposed amendments to the Municipal Code are summarized below and shown <br />in detail in Attachment 1. <br /> <br />Adding §1.04.085 Public Projects. California Government Code section 830.6 provides a <br />statutory basis for public entities to assert a design immunity defense against claims arising <br />out of an alleged design defect. In order for the City to take advantage of the design immunity <br />defense, the plan or design requires discretionary approval prior to construction by the <br />legislative body or other employee exercising discretionary authority to give such approval. <br /> The City Engineer has the background to review and oversee public works projects, and <br />approve the design, and plans and specifications, and any amendments thereto. <br /> <br />In Chapter 2.34 Library Commission. Amends §2.34.030(B) to change the name of <br />"Pleasanton library league" to "Friends of the Pleasanton Public Library." This is to clarify the <br />name of the library league. <br /> <br />In Chapter 3.32 Alternative Bidding Procedures Under the Uniform Public Construction Cost <br />Accounting Act, current language references the specific dollar amounts in Section 22032 of <br />the Public Contract Code. These dollar amounts are subject to change from time to time and <br />such changes would require additional updates to the Municipal Code. This amendment <br />Page 7 of 864
