Typically, conditions, covenants, and restrictions are not enforced by the
City .

There is a resolution to amend the Purchasing Procedures and Manual in Section 3.6 Direct
Payment Claim Form to remove a provision that required City Manager approval for purchases
more than $10,000. This amendment is to maintain consistency with the approval process for
invoices.

EQUITY AND SUSTAINABILITY
Updating the Municipal Code and Purchasing Procedures and Manual furthers the City’s goals
of promoting equity and sustainability. For example, the update promotes equity by closing the
loophole that prohibited model planes in park and recreation facilities while not prohibit drones
or model rotorcraft allows the City to provide equitable enforcement of its code regardless of
the operators financial ability acquire said the aircraft. For sustainability, regulations prohibiting
the use of potable water on non-functional turf serves to eliminate wasteful use of limited
potable water resources.

OUTREACH
No outreach was conducted, as this item is a routine matter of City business.

STRATEGIC PLAN ALIGNMENT
Approval of this action advances the Citywide strategic goal of Safeguarding our City through
the strengthening or clarifying the requirements and prohibitions in the Municipal Code and
therefore the protection of public health.

FISCAL IMPACT
There is no fiscal impact associated with this action.

Prepared by: Submitted by: Approved by:

Wesley Cheung, Deputy City
Attorney
Dan Sodergren, City Attorney

Gerry Beaudin, City
Manager

Attachments:
1.
