Page 1 of 4 <br />Item #1 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />June 17, 2025 <br />City Attorney <br /> <br />TITLE: INTRODUCE AN OMNIBUS ORDINANCE TO AMEND THE MUNICIPAL CODE IN <br />CHAPTERS 1.04 GENERAL PROVISIONS, 2.34 LIBRARY COMMISSION, 3.32 <br />ALTERNATIVE BIDDING PROCEDURES UNDER THE UNIFORM PUBLIC <br />CONSTRUCTION COST ACCOUNTING ACT, 7.20 VICIOUS DOGS, 9.14 <br />STORMWATER MANAGEMENT AND DISCHARGE CONTROL, 13.08 PARKS <br />AND RECREATION FACILITIES, 14.04 REGULATION OF WATER SYSTEM, <br />18.36 RM MULTI-FAMILY RESIDENTIAL DISTRICTS, AND 18.68 PUD PLANNED <br />URBAN DEVELOPMENT DISTRICT; AND ADOPT A RESOLUTION TO UPDATE <br />THE CITY’S PURCHASING POLICY <br /> <br />SUMMARY <br />The omnibus ordinance is a regular process to update the municipal code to reflect new state <br />laws and have the code reflect current practices. These amendments are non-controversial <br />and presented as one ordinance. Omnibus changes are described in more detail in the <br />Discussion section of this report and generally include: <br /> <br />Chapter 1.04.085 Public Projects – adds provision to allow City to assert design immunity for <br />public projects. <br /> <br />Chapter 2.34 Library Commission – amend §2.34.030(B) to change name of "library league" to <br />match actual name of league. <br /> <br />Chapter 3.32 Alternative Bidding Procedures Under the Uniform Public Construction Cost <br />Accounting Act – replaces specified dollar amounts, which are subject to change, with the <br />reference to the Public Contract Code where those dollar amounts are specified. <br /> <br />Chapter 7.20 Vicious Dogs – Amend §7.20.050 Hearing – Schedule – Notice. Amendment to <br />clarify service, hearing requirements and location of hearing. <br /> <br />Chapter 9.14 Stormwater Management and Discharge Control – reintroduce Watercourse <br />protection provisions mistakenly removed upon adoption of the model storm water ordinance <br />on June 4, 2024. <br /> <br />Chapter 13.08 Parks and Recreation Facilities – Amend §13.08.020 Definitions. Amendment to <br />update definitions of "Director" to reflect actual title of position and allow designation of <br />"Director." Amend §13.08.110 Vehicles, to reflect definition change of "Director." Amend <br />§13.08.150 Motor driven cycles and model vehicles and planes. Amendment to language to <br />change prohibition of model “planes” to “aircraft” to close a loophole that did not prohibit <br />drones and rotocraft from park and recreation facilities. <br /> <br />Chapter 14.04 Regulation of Water System and Water Services Fees – Amend §14.04.010. <br />Page 6 of 864
